17.16.010 Establishment of zoning districts.

For the purpose of these regulations, the incorporated area of the Town is classified into the following zoning districts. Additional districts may be added or these districts rezoned by amendment to these regulations.

R-Low

One (1) acre rural zoning district

R1-2

Single-family residential zoning district

R1-4

Single-family residential zoning district

R1-6

Single-family residential zoning district

R-2

Multiple-family residential zoning district

R-3

17.16.020 Boundary lines on the zoning map.

The boundaries of the zoning districts for the Town are shown upon the maps designated "zoning map" for the Town as of the date of the ordinance codified in these regulations. The areas within the Town boundaries shown on these maps, together with all notations, references, and other information shown thereon, are a part of these regulations and have the same force and effect as if said maps and all the notations, references and other information shown thereon were all fully set forth or described herein. 17.16.030 Boundary determination.

Where uncertainty exists with respect to the boundaries of any zoning district shown on the zoning map, the following rules shall apply:

A.    Where zoning district boundaries are indicated as approximately following street or alley lines or the centerlines thereof, such lines shall be construed to be the zoning district boundaries.

B.    Where zoning district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be the zoning district boundaries.

C.    Where zoning district boundaries are indicated as approximately following the line of any stream, irrigation canal or other waterway or railroad right-of-way, or the boundary line of public land, the center of such stream, canal or waterway, or of such railroad right-of-way, or the boundary line of such public land shall be construed to be the zoning districts boundaries.

D.    In unsubdivided land or where a zoning district boundary divides a lot or parcel of land, the location of such boundary, unless indicated by dimensions shown on the zoning district maps, shall be determined by the use of the scale appearing on said maps.

E.    Where such boundaries have been changed by the Town Council pursuant to Chapter 17.132 and where such changed boundaries are shown on detailed maps, the detailed maps shall govern in the event there is any difference between the boundaries shown on the zoning district maps adopted as part of these regulations, or subsequent amendments thereto, and the detailed maps. 17.16.040 Public way vacation.

Whenever any street, alley or other public way is vacated by the Town Council, the zoning districts adjoining each side of such street, alley or public way shall be considered as extended to the center of such vacation and all areas included in the vacation shall then and henceforth be subject to all appropriate regulations of the extended zoning districts. 17.16.050 Lands not previously zoned.

Lands which for reason of law, change in ownership or for any other reason come under the authority of the Town after the ordinance codified in these regulations becomes effective and which have not been zoned prior thereto by any other jurisdiction having zoning authority shall be subject to the regulations of the R-Low one (1) acre zoning district until such time as soon as practicable thereafter public hearings are held as required by law for the express purpose of zoning such lands pursuant to these regulations. 17.16.060 Lands previously zoned by other jurisdiction.

Lands which for reason of law, change in ownership or for any other reason come under the authority of the Town after the ordinance codified in these regulations becomes effective and which have been zoned prior thereto by another jurisdiction having zoning authority shall retain such zoning until such time as soon as practicable thereafter public hearings are held as required by law for the express purpose of zoning such lands pursuant to these regulations. 17.16.070 Interpretation.

In interpreting and applying these regulations, the regulations shall be held to be the minimum requirements for the promotion of the public health, safety and general welfare. It is not intended by these regulations to interfere with, abrogate or annul any ordinance, rules, regulations or permits previously adopted or issued, and not in conflict with any of these regulations, or which shall be adopted or issued pursuant to law relating to the use of buildings or premises and likewise not in conflict with these regulations; nor is it intended by these regulations to interfere with, abrogate or annul any easements, covenants, or other agreements between parties, except that if these regulations impose a greater restriction, these regulations shall regulate. 17.16.080 Land use compliance – Approval required before development.

Land use in any district must comply with the regulations applicable to that district as described in Chapters 17.16 through 17.76 unless a variance is granted. In addition, development of any parcel of property within the Town must receive prior approval by the Town Council, Planning and Zoning Commission or the Director, when applicable, after review of a plot plan or site plan as described in Chapters 17.84 and 17.132. 17.16.090 Sign and parking requirements.

All requirements pertaining to signs in a zoning district shall be those set forth in Chapter 17.108. All requirements pertaining to parking shall be as specified in a particular section, or as specified in Section 17.104.090. (Ord. 15-393 § 1 (part): Ord. 90-82 § (1)(309))
