8.25.010 General.

Notwithstanding any criminal penalties as prescribed under ARS Title 13, a violation of any portion of this title except as outlined below is a civil offense punishable by a civil sanction of not more than $500.00. Each day the violation continues shall constitute a separate and distinct offense. [Prior code § 10-5-1.]

8.25.015 Violation of Chapter 8.10 STC.*

Any person who recklessly places or causes to be placed any rubbish, trash, filth or debris on any property not owned or under the control of that person is guilty of a Class 1 misdemeanor or civil violation unless that person immediately removes or causes to be removed the rubbish, trash, filth or debris from that property.

In addition to any fine or penalty imposed for said violation, that person is liable for all costs that may be assessed pursuant to this section for removing, abating or enjoining the rubbish, trash, filth or debris and for all costs incurred by the owner, lessee, occupant or lienholder of the property in the removal and disposal of the rubbish, trash, filth or debris from that property.

In addition to any fine or penalty imposed in this section, that person is liable for all costs that may be assessed pursuant to this section for removing, abating or enjoining the rubbish, trash, filth or debris and for all costs incurred by the owner, lessee, occupant or lienholder of the property in the removal and disposal of the rubbish, trash, filth or debris.

If required to remove any rubbish, trash, filth or debris pursuant to this section, that person shall provide the town with a receipt from a disposal facility or other documentation evidencing lawful disposal of the rubbish, trash, filth or debris. [Ord. 2013-082 § 2.]

8.25.020 Violation of Chapter 8.20 STC.

A violation of any provision of Chapter 8.20 STC is a petty offense. Each day the violation continues shall constitute a separate and distinct offense. [Ord. 2001-05 § 2; prior code § 10-5-2.]
