17.35.010 Building permit – When not issued.

No permit shall be issued for the erection or use of any structure or part thereof to be located in a subdivision or a minor land division that is not in accordance with the provisions of this title. Any such permit issued shall be void and of no effect. [Ord. 109 § 1, 7-1, 2007.]

17.35.020 Legal proceedings – Abatement.

Any building or structure erected or maintained on a lot or parcel of land that is subject to this title, created or established after adoption of the ordinance codified in this title and that is contrary to the provisions of this title shall be and the same is hereby declared to be unlawful and a public nuisance, and the town attorney shall, upon order of the town council, immediately commence action or proceedings for the abatement, removal and enjoinment thereof, in the manner provided by law; and shall take such other steps and shall apply to such court as may have jurisdiction to grant such relief as will abate or remove such building or structure. 17.35.030 Remedies cumulative.

All remedies provided for herein shall be cumulative and not exclusive. The conviction and punishment of any person hereunder shall not relieve such person from the responsibility of correcting prohibited conditions or removing prohibited buildings, structures or improvements, nor prevent the enforced correction or removal thereof. 17.35.040 Liability.

No liability shall be created on the part of the town or any district, office, department or employee thereof for any damages that may result from the application of these regulations or any administrative decision thereunder. [Ord. 109 § 1, 7-4, 2007.]

17.35.050 Violation – Penalty.

Any person found guilty of violating any provision of this code shall be guilty of a Class 1 misdemeanor. Each day that a violation continues shall be a separate offense punishable as hereinabove described. [Ord. 109 § 2, 2007.]
