14.04.010 Tentative tract maps.

A tentative tract map is required whenever a parcel or number of contiguous parcels of land is proposed to be subdivided for the purpose of creating five or more lots, five or more condominium units, the conversion of five or more existing dwelling units to a stock cooperative, or a community apartment project containing five or more apartment units, except as otherwise provided in this title or the Subdivision Map Act. 14.04.020 Tentative parcel maps.

A tentative parcel map shall be required for the following proposed subdivisions:

A. Whenever a parcel or contiguous parcels of land are proposed to be subdivided for the purpose of creating less than five lots, less than five condominium units, or a community apartment project containing less than five apartment units; or

B. The land before division contains less than five acres, each parcel proposed to be created by the subdivision will abut upon a maintained public street or highway, and all dedications and improvements required by city standards will have been previously complied with; or

C. Each parcel proposed to be created by the subdivision will have a gross area of 20 acres or more and a right of vehicular access for a continuous width of not less than 20 feet to a maintained public street or highway will be provided for each parcel; or

D. The parcel of land proposed to be subdivided is within a tract of land zoned for commercial or industrial uses and abuts streets or highways which have been approved by the city as to alignment and width and to which a right of vehicular access for a minimum continuous width of not less than 28 feet is provided for the parcel; or

E. Each parcel proposed to be created by the subdivision will have a gross area of not less than 40 acres or not less than a quarter of a quarter section. [Ord. 2010-126 § 1 (Exh. A)].

14.04.030 Final maps.

A. A final map shall be required to complete a subdivision when a subdivision is proposed to be created through the tentative map process set forth in this title.

B. A final parcel map shall be based upon a field survey made in conformity with the Land Surveyors Act except that a final parcel map may be compiled from record data when sufficient recorded or filed survey monumentation exists to enable the retracement of the exterior boundary lines of the parcel map and the establishment of the interior parcel or lot lines of the parcel map. 14.04.040 Vesting tentative maps.

A. No vesting tentative map shall be deemed filed unless the intended development of the proposed subdivision is consistent with the city’s general plan and zoning code.

B. At the time a vesting tentative map is filed, the subdivider shall also supply all of the following information and documents:

1. A detailed grading plan which specifies total cubic yards of cut and/or fill and includes estimated total import or export;

2. Diagrams and other information showing existing street, sewer, water, and drainage facilities available to serve the subdivision;

3. Diagrams and information concerning proposed street, sewer, water, and drainage facilities to serve the proposed subdivision, including engineering calculations to support their adequacy;

4. A hydrology study, which shall also include a hydrologic analysis of the proposed drainage facilities to convey runoff from the subdivision in a manner which will not adversely impact downstream properties;

5. A detailed traffic analysis indicating existing traffic conditions, future traffic impact from the proposed subdivision, and any proposed traffic control devices;

6. An acoustical analysis if such an analysis would otherwise be required prior to the construction of dwelling units; and

7. A soils engineering report appropriate to the site as determined by the city engineer.

C. Concurrently with the filing of a vesting tentative map, the subdivider shall file any other applications (conditional use permit, site development permit, etc.) or plans which would otherwise be required prior to the issuance of building permits. No vesting tentative map shall be approved or conditionally approved unless any and all required and concurrently filed applications are also approved.

D. The rights conferred by a vesting tentative map shall be for a period of one year beyond the recording date of the final map or parcel map. When several final maps or parcel maps are recorded on various phases of a project covered by a single vesting tentative map, the one-year time period for each phase shall begin for each phase when the final map or parcel map for that phase is recorded.
