1.16.010 Penalty for violation of code provisions.

A. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of the ordinances of Alpine County shall be guilty of a misdemeanor or an infraction. In any case where the Alpine County Code provides that violation of a provision or provisions is a misdemeanor, the charging authority may, at its discretion and for the fair and reasonable administration of justice, reduce the charge, either at the time of filing or subsequent thereto, to an infraction.

B. Except in cases where a different punishment is prescribed by any ordinance of the county, any person convicted of a misdemeanor for violation of an ordinance of the county is punishable by a fine of not more than five hundred dollars ($500.00), or by imprisonment not to exceed six months, or by both such fine and imprisonment.

C. Any person convicted of an infraction for violation of an ordinance of the county is punishable by:

1. A fine not exceeding fifty dollars ($50.00) for a first violation;

2. A fine not exceeding one hundred dollars ($100.00) for a second violation of the same ordinance within one year;

3. A fine not exceeding two hundred fifty dollars ($250.00) for each additional violation of the same ordinance within one year.

D. This section shall not apply to a violation of any ordinance adopted pursuant to the Vehicle Code of California.

E. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the county is committed, continued or permitted by any such person, and he shall be punishable accordingly.
