REGULATION OF SMOKING IN COUNTY FACILITIES

7.38.010 Prohibition of smoking.

The lighting or smoking of any cigarette, cigar, pipe or other device containing tobacco or similar substance in any county truck or truck tractor except for county trucks and other vehicles while used to plow snow, is prohibited.  State law prohibits the smoking of tobacco products in all county enclosed places of employment, including other county vehicles.  (Ord. 1546 §2, 2002:  Ord. 1535 §2, 2001).

7.38.020 Prohibition of smoking adjacent to doors and ventilation systems of county buildings.

The smoking or holding of any lighted cigarette, cigar, pipe or other device containing tobacco or similar substance within twenty feet of any entrance, exit, covered entryway, open window, or ventilation system intake appurtenant to any building or enclosed facility owned, operated or controlled by Amador County is hereby prohibited.  (Ord. 1564 §3(part), 2003).

7.38.030 Posting of signs.

To aid in the public’s awareness of the ordinance codified in this chapter, but not as a necessary condition of its enforcement or validity, signs may be posted around said entrances, exits, covered entryways, open windows and ventilation system intakes stating that smoking in the area is prohibited.  (Ord. 1564 §3(part), 2003).

7.38.040 Violation an infraction.

The violation of this chapter shall be an infraction which shall be punishable by the payment of a fine not to exceed fifty dollars.  (Ord. 1564 §3(part), 2003:  Ord. 1053 §2(part), 1985).
