REQUIRED AS A CONDITION OF APPROVAL FOR SUBDIVISIONS

17.14.010 Financing for fire protection services.

In order to implement the goals and objectives of the county’s general plan, for the county to meet its requirement to mitigate significant adverse impacts as set forth in the California Environmental Quality Act, and to mitigate impacts caused by new development within the county, financing for increased fire protection services for new parcels is necessary.  (Ord. 1640 §1(part), 2006).

17.14.020 Required participation in community facilities district.

This chapter accomplishes the purpose set forth above.  Each new subdivision is required to participate in the formation of, or annexation to, the county’s proposed Community Facilities District No. 2006-1 (Fire Protection Services) as a condition of approval of any tentative subdivision or parcel map.  The condition of approval shall require the subdivider’s execution of a "waiver and consent" to the expedited election procedure, the successful completion of a landowner-vote election authorizing an annual special tax for fire protection services to be levied on the parcels created by the subdivision or parcel map through the county’s secured property tax roll, and payment of the county’s costs in conducting the procedure.  (Ord. 1640 §1(part), 2006).

17.14.030 Required participation of other development projects.

Each new use allowed by a conditional use permit, which use adds the equivalent impact of a single-family residence or more, is required to participate in the formation of, or annexation to, the county’s proposed Community Facilities District No. 2006-1 (Fire Protection Services) as a condition of approval of the permit.  The county shall condition approval of the permit to require the owner of the parcel on which the use is permitted to execute a "waiver and consent" to the expedited election procedure, the successful completion of a landowner-vote election authorizing an annual special tax for fire protection services to be levied on the parcel on which the use is allowed through the county’s secured property tax roll, and payment of the county’s costs in conducting the procedure.  (Ord. 1640 §1(part), 2006).
