5.48.010 Placing property for sale on public roadway prohibited.

A. Except as provided in BGMC 5.48.020, no person shall place, store, or maintain any article or property on any public roadway, sidewalk, or parkway, or on any other public property in the city, for the purpose of selling, leasing, displaying for sale or lease, or offering for sale or lease, such article or property.

B. The provisions of this section shall not prohibit a seller from taking orders or delivering any commodity from a vehicle on that part of any roadway immediately adjacent to the premises of the purchaser or customer. (Prior code § 4501(a)).

5.48.020 Permit – Issuance authorized – City manager to prescribe regulations.

The city manager shall be authorized to issue permits, subject to the approval of the city council, permitting the display of articles on public property for limited periods of time in connection with organized “sidewalk sales” or other sales promotion campaigns conducted by groups of merchants in the city. In connection with the issuance of such permits, the city manager shall be authorized to prescribe regulations for the conduct of any such sale and display of articles including, but not limited to, the hours of display and the location thereof. 5.48.030 Permit – Certificate of insurance required.

No permit shall be issued pursuant to BGMC 5.48.020 until the applicant for such permit has filed with the city manager a certificate of insurance, evidencing that the applicant has public liability insurance coverage in connection with such sale and sidewalk display in such amounts as may be required by the city manager.
