5.58.010 County code adopted.

Except as provided in this chapter, Parts 1 and 2 of Chapter 7.80 of the Los Angeles County Code (Taxicab Operators and Drivers), being Ordinance Number 5860 of the county of Los Angeles as amended through Ordinance 87-0202, are adopted by reference as an ordinance of the city. The ordinance as now constituted and from time to time amended shall constitute and may be referred to as the taxicab code of the city. (Ord. 552 § 1, 1988).

5.58.020 Definitions.

Whenever any of the name or terms defined in this section are used in the taxicab code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section.

“Business license commission” or “commission” means the planning commission of the city.

“County” or “county of Los Angeles” means the city.

“Section 7.14.010” means and refers to the business license fee schedule adopted annually by the board of supervisors of the county for each fiscal period, except as such schedule may be modified by resolution of the city council pursuant to BGMC 5.58.050.

“Unincorporated area of the county of Los Angeles” shall mean the city of Bell Gardens. (Ord. 552 § 1, 1988).

5.58.030 Section 7.80.660(B) amended.

Section 7.80.660(B) of the taxicab code is amended to read as follows:

B. Notwithstanding the provisions of Sections 7.04.020 and 7.04.030 of this title, any person violating any of the foregoing subsections of this section shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than $1,000 or by imprisonment in the County Jail for a period of not exceeding six months, or by both such fine and imprisonment.

5.58.040 Appeals from decisions of the planning commission.

Any person aggrieved by a decision of the planning commission pursuant to the taxicab code may file a written appeal setting forth the grounds thereof with the city clerk within 10 days after the decision of the planning commission. An appeal shall not be accepted by the city clerk unless it is accompanied by payment of an appeal fee in an amount established by resolution of the city council. Upon filing of an appeal the city council shall hear and determine the matter on appeal within 60 days from the filing with the city clerk. The decision of the city council or, in the event that no appeal is filed within the 10 days, the decision of the planning commission shall be final. (Ord. 552 § 1, 1988).

5.58.050 Permit fees.

The city council may, by resolution, establish the amount of the permit and license fees provided for in the taxicab code. In the event that the city council does not establish said fees, the fee schedule established by the board of supervisors of Los Angeles County pursuant to the taxicab code shall be charged.
