14.280.010 Purpose.

The R-3 high density residential zoning district provides areas of high density residential development at densities not less than 14.1 and not more than 20.0 units per gross acre. This district allows a variety of types of housing, including single-family detached, single-family attached, multifamily, apartments, and residential care facilities. [Ord. 428 § 3 (Exh. 14.280.020 Permitted uses.

Land may be used in the R-3 residential district as provided for in Chapter 14.250 BMC (Residential Use Table). [Ord. 409 § 3, 2017; Ord. 320 § 1, 1999. Formerly 14.115.020]

14.280.030 Conditional uses.

Land may be used, subject to securing a use permit, within the R-3 district as provided for within Chapter 14.250 BMC (Residential Use Table), and in accordance with provisions of Chapter 14.60 BMC (Conditional Use Permits). [Ord. 409 § 3, 2017; Ord. 320 § 1, 1999. Formerly 14.115.030]

14.280.040 Setbacks, lot dimensions, lot coverage, and building height.

Setback for lot boundaries fronting public roads, minimum lot sizes, maximum lot coverage and maximum height restrictions are required for all lots within the R-3 district as follows:

(1) For any structure other than a fence, measured from the front property line.

(2) Repealed by Ord. 428.

(3) An additional five-foot setback shall be required for each additional floor beyond the first when adjacent to the R-1 zoning district.

(4) Land subject to public easements which is not available to the property owner for typical yard uses (excluding permanent improvements or structures) shall not be considered as meeting the minimum lot area requirements.

(5) Minimum lot width for 7,200-square-foot lots within the R-3 district is 60 feet and widths of between 55 feet and 70 feet are considered acceptable. Lot widths outside of this range may be considered by the city in cases where property ownership or physical constraints require variation. However, all options for maintaining appropriate widths of lots must be considered and found infeasible prior to approval of lot widths outside the typical range. Lot widths for multifamily dwellings shall be not less than 60 feet.

14.280.050 Setbacks – Accessory dwelling units.

Accessory dwelling units may be constructed in accordance with the setbacks required for primary units and in accordance with BMC 14.110.115, Accessory dwelling units and junior accessory dwelling units. [Ord. 428 § 3 (Exh. I), 2022; Ord. 409 § 3, 2017; Ord. 329 § 10, 2001. Formerly 14.115.075]

14.280.060 Common open space requirements.

Multifamily development projects within the R-3 district shall provide a minimum of 25 percent of the total lot area as landscaped common areas available for use by residents of the subject property. Such land shall be situated in a location convenient to residents and consolidated into substantial and usable units. No more than 20 percent of total required open space may be provided as perimeter landscaping, with the remaining 80 percent of open space to landscaped and usable by residents.
