9.20.010 Carrying of loaded firearms or shotguns prohibited.

Except as provided in California Penal Code Section 12031, every person who carries a loaded firearm or shotgun on his or her person or in a vehicle while in any public place or on any public street in the incorporated area of the city of Calimesa is guilty of a misdemeanor.

In order to determine whether or not a firearm or shotgun is loaded for the purpose of enforcing this chapter, peace officers are authorized to examine any firearm or shotgun carried by anyone on his or her person or in a vehicle while in any public place or on any public street in the incorporated area of the city of Calimesa. Refusal to allow a peace officer to inspect the firearm or shotgun pursuant to the provisions of this section constitutes probable cause for arrest for a violation of this chapter.

A firearm or shotgun shall be deemed to be loaded for the purposes of this section when there is an unexpended cartridge or shell consisting of a case which holds a charge of powder and a bullet or shot in, or attached in any manner to, the firearm or shotgun, including, but not limited to, in the firing chamber, magazine, or clip thereof attached to the firearm or shotgun; except that a muzzle loader firearm shall be deemed to be loaded when it is capped or primed and has a powder charge and ball or shot in the barrel or cylinder. 9.20.020 Discharge of firearms or shotguns prohibited.

Every person who discharges a firearm or shotgun within the incorporated area of the city of Calimesa is guilty of a misdemeanor. [Ord. 91-31; Code 1990 § 3.2.02.]

9.20.030 Penalty.

A person convicted of a misdemeanor under this chapter shall be punished by a fine of $1,000 or by imprisonment in the county jail for a period of not more than six months, or both. [Ord. 91-31; Code 1990 § 3.2.03.]

9.20.040 Nuisances – Disposition of firearms and shotguns.

A firearm or shotgun of any nature used in the commission of any misdemeanor as provided in the Calimesa Municipal Code is a nuisance and shall be disposed of pursuant to California Penal Code Section 12028. [Ord. 91-31; Code 1990 § 3.2.04.]
