2.21.010 Authorization.

There is established a Department of Planning and Building for the City.

2.21.020 Administration.

Administration of the Department of Planning and Building shall be the responsibility of the Director of Planning and Building.

2.21.030 Creation, powers and duties.

In accordance with California Government Code Section 65100, a Planning Commission is hereby created. The Planning Commission is a separate and distinct body charged with the implementation of the City’s General Plan and implementation of the City’s zoning ordinance and land use policies and other duties as prescribed by law or the Council.

2.21.040 Meetings.

The Planning Commission shall meet on a regular basis which shall be determined by the adoption of the Commission’s operating procedures.

2.21.050 Members, chairperson, secretary selection.

The Planning Commission shall consist of five members. The members of the Planning Commission shall be residents of the City. At the first regular meeting of the calendar year, the Commission shall elect a chairperson and a vice chairperson from among its members. The Director of Planning and Building shall serve as the Secretary to the Planning Commission.

2.21.060 Appointments.

The members of the Planning Commission shall be appointed by the Mayor with approval by a majority vote of the City Council. Candidates for appointment are recruited through requirements as set forth in Government Code Sections 54970 through 54974, the “Maddy Act.” (Ord. 537 § 1, 1998).

2.21.070 Term.

The terms of the individual members shall coincide with the terms of the City Councilmembers. Each term shall be two years. An unlimited number of terms may be served.

2.21.080 Vacancies.

In the event of a vacancy, the vacancy shall be filled by Mayor appointment with approval by a majority vote of the City Council. Candidates for appointment to be recruited through the requirements of the “Maddy Act.” (Ord. 537 § 1, 1998).

2.21.090 Removal.

A member of the Planning Commission may only be removed from office by a majority vote of the Council.

2.21.100 Compensation.

Each member of the Planning Commission may receive compensation for each Planning Commission meeting attended. The amount of the compensation shall be set from time to time by resolution of the Council.
