17.23.010 Purpose.

The purpose of the public district is to provide for a wide variety of uses for the general public benefit and is applied to public or private land areas currently used or planned for public uses. Any allowed uses must be attractively designed and must incorporate measures to ensure compatibility with adjacent residential and commercial uses. (Ord. 460 § 20, 1991).

17.23.020 Uses allowed.

A. Uses allowed in a P district are as follows, and each shall require a use permit:

1. City and County offices, corporation yards, water and wastewater facilities;

2. Parks, libraries, schools, community centers, museums, fairgrounds, churches;

3. Quasi-public uses such as telephone and electric substations;

4. Fraternal buildings and hospitals;

5. Uses determined by the Planning Commission to be similar in nature as provided for according to the procedures in Chapter 17.03 CMC.

B. Allowed Accessory Uses. Accessory buildings and uses that are minor in nature and clearly subordinate to the main use; provided, that no accessory building shall be constructed prior to the construction of the main buildings, nor on a separate lot from the main building. (Ord. 460 § 20, 1991).

17.23.030 Development standards.

The following standards apply to development in the P district:

A. Setbacks for main buildings and accessory buildings shall be as follows:

1. Front yard: 20 feet.

2. Side and rear yards: no requirement unless adjacent to a residential use or zoning district, wherein a 20-foot building setback is required.

B. Maximum floor area ratio: 0.80.

C. Maximum height of buildings and structures: 30 feet, except that when P-zoned property directly abuts residentially zoned property, all structures within 50 feet of the residential property line shall have a height not to exceed the maximum permitted in the adjacent residential district. 17.23.040 Other development standards.

Additional requirements that apply to development in the P district include, but are not limited to, the following:

A. Off-street parking and loading, per Chapter 17.36 CMC.

B. General provisions and exceptions, per Chapter 17.38 CMC.

C. Use permits, per Chapter 17.40 CMC.

D. Design review, per Chapter 17.41 CMC.

E. Fences, hedges or walls, per Chapter 17.52 CMC.

F. Signs and advertising regulations, per Chapter 17.58 CMC. (Ord. 740 § 2 (Exh. A), 2018).

17.23.050 Design review.

New construction, remodel or renovation shall require design review in accordance with Chapter 17.06 CMC.
