3500 Gasoline Service Stations.

(a) Every person offering for sale or selling any gasoline or other motor vehicle fuel, butane, or propane, to the public from any place of business in the City shall post or display a sign which indicates the actual price per gallon, including all taxes, at which each grade of gasoline or other fuel is currently being sold.

(b) No person subject to the provisions of subsection (a) of this Section shall advertise any grade of gasoline or other fuel which is not immediately available for sale to the public on the business premises. The posting of a sign which advertises the unavailability of a particular fuel and which is as visible to the public as the gasoline price signs required under subsection (a) hereof and posted in conformity with Bus. and Prof. C Section 20880 et seq. shall comply with the requirements of this subsection. 3501 Tobacco Distribution.

(a) No person shall sell, permit to be sold or offer for sale any tobacco product by means other than vendor-assisted sales. This prohibition shall preclude the selling and offering for sale of tobacco products by vending machines and self-service displays; provided, however, that this prohibition shall not apply to tobacco shops, cigar lounges and similar establishments. For purposes of this Section, the term “self-service display” shall mean the display of tobacco products in such a manner that the products are accessible by the public without the intervention of the vendor.

(b) No person shall sell, permit to be sold, or offer for sale any tobacco product to a buyer who reasonably appears to be less than twenty-seven (27) years of age unless such buyer has first presented photographic identification establishing that the buyer is not less than eighteen (18) years of age.
