10.24.010 Loading or unloading commercial vehicles restricted.

No person shall load or unload, other than passengers, for any commercial purpose, or as part of or related to any business activity, any commercial vehicle, as defined by the California Vehicle Code, either in or within five hundred feet of any single-family or multifamily residential zone in the city after the hour of ten p.m., nor before the hour of seven a.m. on weekdays, nor before the hour of ten a.m. on Saturdays, Sundays, or any public holiday, as defined in Sections 6700, et seq. of the Government Code or as established pursuant to city ordinances, resolutions or regulations. 10.24.020 Exceptions.

The restrictions set forth in this chapter shall not apply to:

(1) The loading or unloading of any vehicle within a fully enclosed permanent building or structure of which all doors, windows and other potential openings are fully closed at the time of such loading and unloading; or

(2) The loading or unloading of any vehicle on any premises where the city has, either prior to or after the effective date of the ordinance codified in this chapter, approved a precise plan or conditional use permit setting forth permissible hours for such loading or unloading different from those contained in this chapter, and in such event, the hours stated in the precise plan or conditional use permit, as such may be amended from time to time, shall control.
