41.13.010 Loud, unusual noises Prohibited.

It is unlawful for any person to make, continue or cause to be made or continued within the City limits any loud, unnecessary or unusual noise which injures or endangers the health, peace or safety of others. (HS § 39800 et seq.)

41.13.020 Loud, unusual noises Designated.

The acts set forth in CMC 41.13.030 through 41.13.120, among others, are declared to be loud, disturbing and unnecessary noises in violation of this section but such enumeration shall not be deemed to be exclusive.

41.13.030 Horns, signaling devices, etc.

The sounding of any horn or signaling device on any automobile, motorcycle, streetcar or other vehicle on any street or public place of the City, except as a danger warning; the creation by means of any such signaling device of any unreasonably loud or harsh sound; and the sounding of any device for an unnecessary and unreasonable period of time and the use of any signaling device where traffic is for any reason held up are declared to be loud, disturbing and unnecessary noises.

41.13.040 Radio, phonographs, etc.

The using, operating, or permitting to be played, used or operated any radio receiving set, musical instrument, phonograph, or other machine or device for the producing or reproducing of sound in such manner as to disturb the peace, quiet and comfort of the neighboring inhabitants or at any time with louder volume than is necessary for convenient hearing for the person or persons who are in the room, vehicle or chamber in which such machine or device is operated and who are voluntary listeners thereto are declared to be loud, disturbing and unnecessary noises. The operation of any such set, instrument, phonograph, machine or device between the hours of 9:00 p.m. and 8:00 a.m in such a manner as to be plainly audible at a distance of 50 feet from the building, structure or vehicle in which it is located shall be prima facie evidence of a violation of this section.

41.13.050 Loudspeakers, amplifiers for advertising.

The using, operating or permitting to be played, used, or operated of any radio receiving set, musical instrument, phonograph, loudspeaker, sound amplifier, or other machine or device for the producing or reproducing of sound which is cast upon the streets for the attention of the public to any building structure is declared to be loud, disturbing, and unnecessary noise.

41.13.060 Yelling, shouting, etc.

Loud or raucous yelling, shouting, hooting, whistling, or singing on the public streets, particularly between the hours of 9:00 p.m. and 8:00 a.m. or at any time or place so as to annoy or disturb the quiet, comfort, or repose of persons in any office, or in any dwelling, hotel, or other type of residence, or of any person in the vicinity is declared to be loud, disturbing, and unnecessary noise.

41.13.070 Animals, birds, etc.

The keeping of any animal or bird which by causing frequent or long continued noise shall disturb the comfort or repose of any persons in the vicinity is declared to be loud, disturbing, and unnecessary noise; provided, however, that nothing contained herein shall be construed as applying to occasional noises emanating from legally operated dog and cat hospitals, humane societies and the City pounds.

41.13.080 Exhausts.

The discharge into the open air of the exhaust of any steam engine, stationary internal combustion engine, motorboat, or motor vehicle except through a muffler or other device which will effectively prevent loud or explosive noises therefrom is declared to be loud, disturbing, and unnecessary noise.

41.13.090 Schools, courts, churches, hospitals.

The creation of any excessive noise on any street adjacent to any school, institution of learning, church, or court while the same are in use, or adjacent to any hospital, which unreasonably interferes with the workings of such institutions, or which disturbs or unduly annoys patients in the hospital, provided conspicuous signs are displaced in such streets indicating that the same is a school, hospital or court street, is declared to be loud, disturbing, and unnecessary noise.

41.13.100 Hawkers and peddlers.

The shouting and crying of peddlers, hawkers, and vendors which disturbs the peace and quiet of the neighborhood is declared to be loud, disturbing, and unnecessary noise.

41.13.110 Drums.

The use of any drum or other instrument or device for the purpose of attracting attention by the creation of noise to any performance, show or sale is declared to be loud, disturbing, and unnecessary noise.

41.13.120 Blowers.

The operation of any noise-creating blower or power fan or any internal combustion engine, the operating gases or fluids, unless the noise from such blower or fan is muffled and such engine is equipped with a muffler device sufficient to deaden such noise, is declared to be loud, disturbing and unnecessary noise.

41.13.130 Hospital quiet zones Established.

All territory within a distance of 200 feet in all directions from any hospital, sanitarium, or similar institution in the City is to be a quiet zone.

41.13.140 Hospital quiet zones Loud noises prohibited.

It is at all times unlawful for any person to make, cause or allow to be made any loud or unusual noise in such quiet zones or to sound or play upon any musical instrument therein between the hours of 10:00 p.m. and 7:00 a.m.

41.13.150 Motor vehicle noises.

Any excessive, unusual, loud, or disturbing noise made by any motor vehicle and not reasonably necessary in its operation under the circumstances shall include but not be limited to noise caused by screeching or tires, racing or accelerating the engine, backfiring the engine and exhaust from the engine tail pipe or muffler.

41.13.160 Penalty for violation.

Any person, firm or corporation which violates a provision of this chapter shall be guilty of an infraction. (Ord. 1400)
