56.03.010 Police administration.

There is hereby established in the Police Department of this City a Traffic Division to be under the control of an Officer of Police appointed by and directly responsible to the Director of Police Services.

56.03.011 Duty of Traffic Division.

It shall be the duty of the Traffic Division with such aid as may be rendered by other members of the Police Department to enforce the traffic regulations of this City and all of the State vehicle laws applicable to street traffic in this City, to make arrests for traffic violations, to investigate traffic accidents and to cooperate with the City Engineer and other officers of the City in the administration of the traffic laws and in developing ways and means to improve traffic conditions, and to carry out those duties specially imposed upon said division by this code and the traffic ordinances and resolutions of this City.

56.03.012 Traffic accident studies.

Whenever the accidents at any particular location become numerous, the Traffic Division shall cooperate with the City Engineer in conducting studies of such accidents and determine remedial measures.

56.03.013 Traffic accident reports.

The City Engineer shall maintain a suitable system of filing traffic accident reports. Such reports shall be available for the use and information of the Traffic Division.

56.03.014 Annual traffic safety report.

The City Engineer, in cooperation with the Police Department, shall annually prepare a traffic report which shall be filed with the City Council. Such a report shall contain information on traffic matters in this City as follows:

A. Traffic accident data, including the number of traffic accidents, the number of persons killed and the number of persons injured;

B. The number of traffic accidents investigated and other pertinent data on the safety activities of the City; and

C. The plans and recommendations of the City staff for future traffic safety activities.

56.03.020 City Traffic Engineer.

The City Engineer shall serve as City Traffic Engineer in addition to his other functions; provided, however, that the City Engineer may designate a suitably qualified individual under his supervision as the Traffic Engineer for the purpose of exercising the powers and duties with respect to traffic prescribed herein.

56.03.021 Powers and duties of City Engineer relating to traffic.

It shall be the general duty of the City Engineer to determine the installation and proper timing and maintenance of traffic control devices and signals, to conduct engineering analyses of traffic accidents and to devise remedial measures, to conduct engineer and traffic investigations of traffic conditions and to cooperate with other City officials in the development of ways and means to improve traffic conditions, and to carry out the additional powers and duties imposed by ordinances and resolutions of this City. Whenever, by the provisions of this code an authority is granted to the City Engineer or a duty imposed upon him, the authority may be exercised or the duty performed by his deputy or by a person authorized in writing by him.

56.03.040 Traffic regulations by resolutions.

Any traffic regulation not inconsistent with an adopted ordinance of the City or statute of the State of California may be adopted and established by resolution of the Council.

56.03.050 State approval required.

Whenever any provision of this code or any ordinance or resolution delegates authority to a City Officer, or authorized action by the Council, to regulate traffic upon a State highway in any way which by State law requires the prior approval of the State Department of Transportation, no such officer shall exercise such authority nor shall such action by the Council be effective with respect to any State highway without the prior approval in writing of the Department of Transportation when and to the extent required by the Vehicle Code.

56.03.051 Withdrawal of State approval.

Any provision of this code or any ordinance or resolution which regulates traffic or delegates the regulation of traffic upon State highways in any way for which the approval of the State Department of Transportation is required by State law shall cease to be operative six months after receipt by City of written notice of withdrawal of approval of the Department of Transportation.
