82.80.010 Requirement.

The Director of the Department of Community Development shall investigate reported violations of this title and initiate enforcement proceedings as required.

82.80.020 Lots created prior to March 4, 1972.

Any parcel created prior to March 4, 1972, shall be dealt with in accordance with the Act. (Gov. Code § 6412.6)

82.80.030 Withholding development permits and approvals.

In accordance with the Act, the City may deny or conditionally approve the issuance of permits or other approvals necessary to develop real property divided in violation of the provisions of this title or the Act. (Gov. Code § 66499.34)

82.80.040 Certificate of compliance.

A. The City shall issue certificates of compliance in accordance with the Act. (Gov. Code § 66499.35)

B. Upon the payment of a fee established by resolution of the City Council, any person owning real property or a vendee of such owner pursuant to an existing contract of sale may apply to the Director of Engineering Services for determination as to whether such real property complies with the provisions of this title and the Act.

C. The Director of Engineering Services may issue a certificate of compliance and impose conditions in accordance with the Act.

D. A certificate of compliance shall identify the real property involved by reference to a previously recorded final map, parcel map or official map, or, if none, by the concurrent recording of a map.

E. The determination of the Director of Engineering Services shall become final 10 calendar days after the decision unless an appeal is filed.

F. Within 10 calendar days after the decision denying or conditioning an application, the applicant may appeal the decision to the City Council by filing with the City Clerk a notice of appeal in accordance with Chapter 1.12 CMC. (Ord. 2025 §§ 17, 18, 2011; Ord. 1673; Ord. 1658)

82.80.050 Notice of violation.

The City shall record notices of violations in accordance with the Act. (Gov. Code § 66499.36)

82.80.060 Merger of parcels.

The City shall process merger of parcels in accordance with the Act, utilizing the procedures applicable to lot line adjustments. (Gov. Code §§ 66451.10 through 66451.21) (Ord. 1601)

82.80.070 Unmerger of parcels.

The City shall proceed with the unmerger of parcels in accordance with the Act. (Gov. Code §§ 66451.25 through 66451.33) (Ord. 1601)
