5.18.010 Definitions.

The following words and phrases when used in this chapter shall have the meanings ascribed to them in this section:

A. “Holiday parade” means the annual Covina Holiday Invitational Parade conducted in the month of December, sponsored by the city and occurring on certain designated streets within the city.

B. “Parade committee” means the committee of individuals, created by resolution by the city council, that is responsible for planning, promoting and conducting the holiday parade.

C. “Permit” means a valid holiday parade vendor/solicitor permit issued by the city.

D. “Vending” means the selling of or offering to sell any item of personal property, including foodstuffs and services.

E. “Solicitation” means the appeal to the public for gifts, contributions, donations or subscriptions. (Ord. 1423 § 1, 1979; Ord. 1358 § 1, 1977.)

5.18.030 Holiday parade vendor/solicitor permit.

Every person desiring a permit for the current year shall, on or before October 15th of each year, submit to the finance director an application for a holiday parade vendor/solicitor permit, which application:

A. Shall clearly identify the name and address of the applicant, shall state whether the applicant is an unincorporated association or a corporation, and shall set forth such other information pertaining to the organization as the finance director may require;

B. Shall be made in writing and addressed to the parade committee;

C. Shall set forth the proposed items to be sold and the area where such sales or solicitations are to be made; and

D. Shall set forth the number of persons who will be engaged in the sales or solicitations and shall set forth the name, address and telephone number of the supervisory person who shall be responsible for the applicant’s members actually engaged in vending or soliciting activities.

The finance director shall present all such applications, together with his recommendations, to the parade committee not later than the thirty-first day of October. Applicants shall be notified by the finance director of the granting or rejection of their applications for permits not later than November 5th of that calendar year. Any person aggrieved by decision of the parade committee may appeal to the city council by filing a notice of appeal with the city clerk. (Ord. 1423 § 1, 1979; Ord. 1358 § 1, 1977.)

5.18.040 Limitation on number of permits.

The parade committee shall have the right to limit the number of permits in order to ensure compatibility with the overall activities involved in the holiday parade event. The parade committee shall also have the right to limit the number of persons permitted to engage in vending or solicitation for each organization. The parade committee shall consider, but not be limited to, the following criteria in its consideration and granting of such permits:

A. The necessity of ensuring the public safety, health and general welfare;

B. The necessity of maintaining and ensuring traffic and crowd control in order that the holiday parade may progress unimpeded with an opportunity for all members of the public to view and enjoy the event; and

C. The necessity to ensure that the public is adequately served. (Ord. 1423 § 1, 1979; Ord. 1358 § 1, 1977.)

5.18.050 Supplemental rules and regulations.

Vendors and solicitors shall not be on the streets along the parade route where the holiday parade is actually in progress. No items shall be sold that might endanger the general welfare of the public or parade participants such as, but not limited to, peashooters, noisemakers, and horns. All pressurized balloon vessels shall be secured. The parade committee shall have the right to establish additional rules and regulations to be followed by vendors and solicitors on the day of the holiday parade in order to promote an orderly sales process, to prevent litter in the public streets, and to promote the general welfare of the city. Such rules and regulations shall be furnished to each applicant at the time it makes an application for a permit. (Ord. 1423 § 1, 1979; Ord. 1358 § 1, 1977.)
