11.28.010 Permit – Required.

It is unlawful for any person to construct, maintain or repair any awning or hood extending over streets and sidewalks in the city without first having obtained a written permit from the building director or the city council to perform such work of construction or repair. (1964 Code § 23.63.)

11.28.020 Permit – Contents.

Each permit required by CMC 11.28.010 shall contain the restrictions provided for in CMC 11.28.050. (1964 Code § 23.64.)

11.28.030 Combustible coverings.

Movable awnings or hoods may have combustible coverings supported on frames attached to any building in the city. (1964 Code § 23.65.)

11.28.040 Extensions over sidewalks.

No awning or hood shall extend over the public sidewalk of the city for more than two-thirds the distance from the property line to the nearest curb line in front of the building site. (1964 Code § 23.66.)

11.28.050 Height.

The lowest part of any movable awning or hood frame shall not be less than seven and one-half feet above the ground immediately below. The lowest part of any fringe or covering attached to such awning or hood shall not be less than seven feet above the grade immediately below. (1964 Code § 23.67.)

11.28.060 Chapter interpretation.

The provisions of this chapter shall be held to be the minimum requirements adopted for the protection of the safety of the community, the people who may use the sidewalks and for the safety of the occupants of the buildings in the city. (1964 Code § 23.68.)
