R-1-10,000 RESIDENTIAL ZONE (SINGLE-FAMILY)

17.22.010 Intent.

This zone is intended to provide for the development of single-family homes on large homesites, not more than one dwelling unit permitted on any lot. (1964 Code Appx. A § 3.10.)

17.22.020 Permitted uses.

Buildings, structures and land shall be used, and buildings and structures shall hereafter be erected, structurally altered or enlarged only for the following uses, plus such other uses as the commission and council may deem (pursuant to Chapter 17.60 CMC) to be similar and not more obnoxious or detrimental to the public health, safety and welfare. All uses shall be subject to the property development standards in CMC 17.22.050 through 17.22.110 and to those of the R-1-7500 zone, CMC 17.26.160 through 17.26.300:

A. Single-family dwellings, not more than one dwelling per lot, except that an accessory dwelling unit permitted under this chapter shall not count toward the one dwelling per lot limitation;

B. Guest house, subject to the regulations of CMC 17.04.291;

C. Private dance, only when conducted in conjunction with a church or school;

D. The keeping, for noncommercial purposes, of such animals as permitted in the R-1-20,000 residential zone in accordance with CMC 17.20.020(D);

E. Occasional sale;

F. In-home business permitted in accordance with CMC 17.26.035 of the R-1-7500 residential zone;

G. Accessory dwelling unit, subject to the regulations in Chapter 17.69 CMC;

H. Two-Unit Development and Urban Lot Splits. The provisions of Chapters 16.02 and 16.06 CMC and CMC 17.33.060 shall apply. 17.22.030 Uses permitted subject to conditional use permit.

The uses permitted subject to conditional use permit in the R-1-7500 zone, CMC 17.26.030, may be so permitted in this zone. (1964 Code Appx. A § 3.12.)

17.22.040 Prohibited uses.

The uses expressly prohibited in the R-1-7500 zone, CMC 17.26.040, shall be prohibited in this zone. (1964 Code Appx. A § 3.13.)

17.22.050 Property development standards generally.

The property development standards of the R-1-7500 zone, CMC 17.26.160 through 17.26.300, shall apply to all land and buildings in the R-1-10,000 zone. In addition, the property development standards contained in CMC 17.22.060 through 17.22.110 shall apply, except that any lot held under separate ownership or that was of record on the effective date of the ordinance codified in this title which is substandard in area or dimensions may be used subject to all other standards. 17.22.060 Lot area.

Each lot shall have a minimum area of 10,000 square feet. For method of measurement, see definition of “lot area,” CMC 17.04.360. (1964 Code Appx. A § 3.14.)

17.22.070 Lot dimensions.

All lots hereafter created shall comply with the following minimum standards and lots now held under separate ownership or of record may not be reduced below these standards. For method of measurement, see definitions of “lot depth” and “lot width,” CMC 17.04.369 and 17.04.405, respectively:

A. Width.

1. Interior lots shall have a minimum width of 80 feet.

2. Corner lots shall have a minimum width of 82.5 feet.

3. Reversed corner lots shall have a minimum width of 85 feet.

4. Lots siding on freeways, public schools or recreation areas, or railroad rights-of-way shall have a minimum width of 105 feet.

5. Cul-de-sac lots shall have a minimum width of 45 feet at the front lot line and a minimum lot width of 80 feet at the front building setback line.

B. Depth.

1. Lots facing on local street shall have a minimum depth of 110 feet.

2. Lots facing or backing on major or secondary highways shall have a minimum depth of 120 feet.

3. Lots backing on a freeway, public school or recreation area, or railroad right-of-way shall have a minimum depth of 125 feet. (1964 Code Appx. A § 3.14.)

17.22.080 Population density.

There shall be a minimum of 10,000 square feet of lot area for each dwelling unit; and provided, however, that there shall be no more than one dwelling unit on any one lot; provided, however, that one accessory dwelling unit authorized by this title may be located upon the same lot as the primary dwelling unit without exceeding the density limitations prescribed herein. 17.22.090 Building height – Generally.

No building or structure erected in this zone shall have a height greater than two and one-half stories or 35 feet, whichever is less. (1964 Code Appx. A § 3.14.)

17.22.100 Building height – Exceptions – Permitted projections above limit.

The provisions of the R-1-7500 zone, CMC 17.26.100, shall apply. (1964 Code Appx. A § 3.14.)

17.22.110 Yards – Generally.

The yard provisions of the R-1-7500 zone, CMC 17.26.110 through 17.26.150, shall apply, except that each lot shall have a side yard on each side of not less than 10 feet. Other side yard provisions of the R-1-7500 zone, CMC 17.26.130(B) through (G), shall apply. (1964 Code Appx. A § 3.14.)

17.22.120 Site plan review.
