5.46.010 Business license and regulatory permit required.

It is unlawful for any person to conduct, permit, or facilitate any street faire, special event, or farmers’ market without first having procured a business license required by Chapter 5.04 EMC and this chapter. This chapter provides two options for individual vendors within a street faire, special event, or farmers’ market that is licensed and permitted pursuant to this chapter. (Ord. 585 § 2.5 (Exh. 5.46.020 Regulatory requirements.

All farmers’ markets must comply with all requirements in Part 7 of Division 104 of the Health and Safety Code, obtain and/or comply with any local laws and regulations, including, but not limited to, the following requirements:

A. Provide written permission of the owner of private property where any farmers’ market will be located;

B. Limit the market to certain days or times;

C. Provide adequate parking;

D. Provide and maintain disabled access routes;

E. Provide adequate restrooms;

F. Implement best management practices to prevent trash and other pollutants from entering stormwater; and

G. Provide proof of insurance in a form acceptable to the city attorney. (Ord. 585 § 2.5 (Exh. A), 2020)

5.46.030 Licensing options.

Individual vendors operating at a street faire, special event, or farmers’ market may procure individual business licenses or may operate under the business license held by the street faire, special event, or farmers’ market. Fees for each option shall be established by resolution of the city council. (Ord. 585 § 2.5 (Exh. A), 2020)
