9.10.020  Unclaimed bicycles and toys used in programs to prevent delinquency.

9.10.010 Definitions.

The following words, terms and phrases when used herein have the meaning ascribed to them in this section except where the context clearly indicates a different meaning:

A. “Unclaimed bicycles and toys” means bicycles or toys that have been held by the police department for a period of at least 120 days when the owner cannot, with reasonable diligence, be found, or, being found, refuses upon demand to pay the lawful charges provided by Section 2080.1 of the California Civil Code where the police department may require payment by the owner of a reasonable charge to defray costs of storage and care of the property.

B. “Delinquency” means the condition of a person lacking in a moral or social sense. (Ord. 472 § 1, 2003)

9.10.020 Unclaimed bicycles and toys used in programs to prevent delinquency.

Any bicycles or toys, or both, in the possession of the police department of the city which have been unclaimed for a period of at least 100 days may, instead of being sold at public auction to the highest bidder pursuant to the provisions of Section 217 of the Juvenile Justice Law (Welfare and Institutions Code), be used in a program or activity designed to prevent juvenile delinquency and which is exempt from income taxation under federal or state law, or both, for use in any program or activity designed to prevent juvenile delinquency. These programs may include, but are not limited to the following:

A. The “Mary Graham Hall” temporary shelter for abused and neglected children;

B. The juvenile probation (CO-OP) program;

C. Underprivileged children with the Escalon Unified School District;

D. Other charitable and/or nonprofit organizations, which meet the requirements of Section 217 of the Welfare and Institutions Code. (Ord. 472 § 1, 2003)
