9.24.010 Purpose.

Every citizen has the right to choose for himself or herself whether to smoke tobacco, and it is not the intention of the city to interfere with such freedom of choice. Further, every citizen who chooses not to smoke has the right to be free from offensive tobacco smoke and to be free from the health hazard of tobacco smoke when employed by the city or conducting business with the city in specified areas. 9.24.020 Definitions.

A. “City buildings” mean any area closed in by a roof and four walls with appropriate openings for ingress and egress owned or leased by the city.

B. “Smoking” means the carrying or holding of a lighted pipe, cigar or cigarette of any kind, or any other lighted smoking equipment or the lighting or emitting or exhaling the smoke of a pipe, cigar or cigarette of any kind. (Ord. 335 § 1, 1990)

9.24.030 Nonsmoking areas.

Smoking is prohibited in all areas of the interior of all city buildings except in specifically designated smoking areas. (Ord. 335 § 1, 1990)

9.24.040 Smoking areas.

Consistent with the purpose of this chapter, the city manager may designate specific areas of city buildings as designated smoking areas. (Ord. 335 § 1, 1990)

9.24.050 Signs or notices.

Appropriate “No Smoking” signs shall be conspicuously posted in each area of those city buildings where smoking is prohibited by this chapter. “Designated Smoking Area” signs shall be conspicuously posted in each area of city buildings designated as smoking areas. (Ord. 335 § 1, 1990)

9.24.060 Violation – Penalties.

A. Any person who is smoking where smoking is prohibited by this chapter shall be guilty of an infraction, punishable by:

1. A fine, not exceeding $100.00 for a first violation;

2. A fine, not exceeding $200.00 for a second violation of this chapter within one year;

3. A fine, not exceeding $500.00 for each additional violation of this chapter within one year.

B. Each day during which this chapter is violated shall constitute a separate and distinguishable violation of this chapter. (Ord. 335 § 1, 1990)
