Article I. Licensing

10.20.010 License required.

It is unlawful for any person to operate or use a bicycle propelled wholly or in part by muscular power upon any of the streets, alleys or public highways of the city, without first obtaining from the police department a license therefor. (Ord. 302 § 2, 1988)

10.20.020 License application and issuance.

The police department is authorized and directed to issue upon request of the owner, the bicycle license indicia and the registration form distributed by the State Department of Motor Vehicles to any owner of a bicycle which complies with Section 39007 of the California Vehicle Code. Bicycle licenses shall be effective from the date of issuance and shall be renewable on January 1st of the third year following the year of registration. Such license when issued shall entitle the licensee to operate such bicycle for which the license has been issued, upon all the streets, alleys and public highways, exclusive of the sidewalks thereof. 10.20.030 License fees.

The fees required to be paid pursuant to the provisions of this article are:

A. For each new bicycle license and registration certificate: $6.00;

B. For each transfer of registration certificate: $1.00;

C. For each replacement of a bicycle license or registration certificate: $1.00;

D. For each bicycle license renewal: $3.00. (Ord. 302 § 7, 1988)

10.20.040 Attachment and recordation of license.

The city shall provide the bicycle license indicia and registration forms procured and distributed by the State Department of Motor Vehicles, said licenses and registration cards having a unique license number permanently assigned to a bicycle. It shall be the duty of the police department to attach one such license to the front of the seat tube of the bicycle frame, and to issue a corresponding registration card to the licensee upon the payment of the license fee herein provided for. Such license shall remain attached during the existence of such license. The police department shall also keep a record of each bicycle registered. Such records shall include the date of issuance of such license, the license number, the serial number of the bicycle, the make and type of the bicycle, and the name and address of the licensee. 10.20.050 Report of sale or transfer of ownership.

It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or transfer by returning to the police department the registration card issued to such person as licensee thereof, endorsed with the name, address, and telephone number of the person to whom said bicycle was sold or transferred, the date of transfer, and the signature of the transferrer. Such report shall be made within 10 days of said sale or transfer. (Ord. 302 § 5, 1988)

10.20.060 Removal, alteration or destruction of bicycle number or license unlawful.

It is unlawful for any person to wilfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this article. It shall also be unlawful for any person to remove, destroy, mutilate or alter any license, seal or registration card during the time in which such license, seal or registration card is operative; provided, however, that nothing in this article shall prohibit the police department from stamping numbers on the frames of bicycles on which no serial number can be found, or on which said number is illegible or insufficient for identification purposes. Article II. Riding Restrictions

10.20.080 Riding or parking on sidewalk unlawful.

It is declared unlawful for any person to ride or park a bicycle upon any sidewalk in the city. (Ord. 301 § 1, 1988; Ord. 33 § 1, 1958)

10.20.090 Impoundment for violation.

The police department of the city or any members thereof may impound and retain possession of any bicycle operated in violation of the provisions of this article, and retain possession of the same for a period of not more than 90 days. None of the penalties imposed by this section is exclusive of the others and the enforcement of one of said penalties is not dependent upon enforcement of the others. (Ord. 33 § 2, 1958)

10.20.100 Violation an infraction.

It is unlawful and constitutes an infraction for any person to violate or fail to comply with any provision of this chapter. (Ord. 470, 2003; Ord. 206 § 1, 1981; Ord. 33 § 3, 1958)
