1.16.010 Violation deemed misdemeanor – Exception.

Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this code shall be guilty of a misdemeanor, unless the violation is made an infraction by ordinance. (Ord. 121, 1983)

1.16.020 Each day deemed separate offense.

Each person described in EMC 1.16.010 shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of this code is committed, continued or permitted by any such person, and he shall be punishable accordingly. (Ord. 121, 1983)

1.16.030 Penalty for violation – Misdemeanor.

Except in cases where a different punishment is prescribed by this code, any person convicted of a misdemeanor for violation of this code is punishable by a fine of not more than $500.00, or by imprisonment not to exceed six months, or by both such fine and imprisonment. (Ord. 121, 1983)

1.16.040 Penalty for violation – Infraction.

Any person convicted by an infraction for a violation of this code is punishable by a fine not exceeding $50.00 for a first violation; a fine not exceeding $100.00 for a second violation of the same ordinance within one year; or a fine not exceeding $250.00 for each additional violation of the same ordinance within one year. (Ord. 121, 1983)

1.16.050 Code and ordinance synonymous.

Wherever reference is had to this code, or to the ordinances of this code, the same shall be deemed to mean and include the ordinances of the city of Etna; provided, however, that as to any violation of any ordinance of the city of Etna heretofore committed, the ordinance so violated shall continue in full force and effect as to such violation.
