17.20.010 Purpose.

This zone district is intended to provide a specialized commercial zone for the downtown commercial district. (Ord. 223 § 1, 2022; Ord. 186, 2003)

17.20.020 General plan consistency.

This zone district is consistent with the central business district land use designation. (Ord. 223 § 1, 2022; Ord. 186, 2003)

17.20.030 Density/intensity.

A. One to 20 housing units per gross acre.

B. Minimum Parcel Size.

1. New parcels: 5,000 square feet.

2. Existing parcels: 2,500 square feet.

C. Maximum Lot Coverage.

1. New parcels: 75 percent.

2. Existing parcels: 100 percent. (Ord. 223 § 1, 2022; Ord. 186, 2003)

17.20.040 Site development standards.

A. Setbacks.

1. Front.

a. Commercial uses and vertical mixed-use developments: None.

b. Residential uses: See R-3 zone district.

2. Rear.

a. Commercial uses and vertical mixed-use developments:

i. Adjacent commercial or vertical mixed-use development: None.

ii. Adjacent residential: 10 feet.

b. Residential uses: See R-3 zone district.

3. Side.

a. Commercial uses and vertical mixed-use developments:

i. Adjacent commercial or vertical mixed-use development: None.

ii. Adjacent residential: 10 feet.

b. Residential uses: See R-3 zone district.

B. Building.

1. Height: 45 feet.

2. Distance between buildings: As required by California Building Code.

C. Lot Dimensions.

1. Width.

a. New parcels: 50 feet.

b. Existing parcels: None.

2. Depth.

a. New parcels: 90 feet.

b. Existing parcels: None.

D. Parking.

1. Commercial uses and vertical mixed-use developments:

a. New retail: One parking space for each 300 square feet of floor area.

b. New professional office: One parking space for each 200 square feet of floor area.

c. New vertical mixed-use development: One parking space per residential dwelling unit plus commercial parking requirement.

d. Existing: None.

2. Residential uses (no mixed use): See R-3 zone district.

3. Each required parking space shall have a minimum dimension of nine feet by 19 feet.

E. Signs. A single sign per each street frontage not exceeding 100 square feet in accordance with EMC 17.34.190. (Ord. 223 § 1, 2022; Ord. 189 § N, 2003; Ord. 186, 2003)

17.20.050 Permitted uses.

The following uses are permitted in the C-1 zone district subject to issuance of a building permit, business license or other required permit(s):

A. Retail business establishments within a building, conducting sale of the following: apparel, auto parts, books, drugs, computers and software, confectionery, department stores, flowers, food, furniture, general merchandise, crafts, gifts, hardware, household appliances, jewelry, liquor, office supply, periodicals, photo supplies, shoes, sporting equipment, video rentals and similar commercial uses.

B. Retail business establishments within a building, and possibly having some outside and incidental sales including: restaurants and snack bars, nurseries, service stations.

C. Personal service establishments including: banks, pet grooming and veterinary services (no boarding), barber and beauty shops, professional offices, office services, photography studios, photocopying services, radio and television sales and repair, shoe and other small item and apparel repair.

D. Vertical mixed-use developments that include one or more of the commercial uses in subsection (A), (B), or (C) of this section, excluding service stations, when the commercial use is located at street level and the residential use is located above or below street level. 17.20.060 Accessory uses.

The following uses are permitted in the C-1 zone district as an accessory to the primary permitted or conditionally permitted use:

A. Garage or carport.

B. Fences, walls.

C. Temporary outside sales such as sidewalk or patio sales.

D. Accessory dwelling units consistent with the provisions of Chapter 17.52 EMC.

E. Usual and customary structures associated with a commercial use. (Ord. 223 § 1, 2022; Ord. 220 § 8, 2021; Ord. 186, 2003)

17.20.070 Conditional uses.

The following uses are permitted in the C-1 zone district upon approval and validation of a conditional use permit, in addition to any other permits or licenses required for the use. Setbacks and development criteria may be amended during the conditional use permit process:

A. Residential uses consistent with the R-3 zone district when the residential use is located at street level or is not included within a vertical mixed-use development as provided for in EMC 17.20.050(D).

B. Veterinary offices with overnight boarding and hospitalization.

C. Theaters, schools (public or private) and churches.

D. Public and Quasi-Public Facilities.

1. Electrical substations.

2. Fire, police or sheriff substation.

3. Parks, picnic areas and playgrounds not associated with approved development.

4. Water and wastewater treatment facilities.

E. Sales or uses conducted primarily outside of a building.

F. Modified or joint use parking standards.

G. Breweries, creameries, wineries.

H. Bars, lodges, dormitory establishments.

I. Transient residential uses such as motels, hotels, bed and breakfasts, etc.

J. Buildings and structures taller than specified in EMC 17.20.040(B).

K. Large group care home of clients pursuant to the California Health and Safety Code subject to review for overconcentration.

L. Senior care facility.
