14.35.010 Purpose.

The purpose of this chapter is to adopt a process consistent with Government Code Section 65850.7, whereas the chief building official shall implement an expedited administrative permit review process for electric vehicle charging stations, and implement a checklist of all requirements with which electric vehicle charging stations shall comply in order to be eligible for expedited review. The expedited administrative permit review process and checklist may refer to the recommendations in the checklist prescribed by the most current version of the “Plug-In Electric Vehicle Infrastructure Permitting Checklist” of the “Zero-Emission Vehicles in California: Community Readiness Guidebook” published by the Governor’s Office of Planning and Research. The city’s checklist shall be published on the city’s website. (Ord. 1278 § 2 (part), 2017)

14.35.020 Applicability.

A.    This chapter applies to the permitting of all electric vehicle charging stations in the city.

B.    Electric vehicle charging stations legally established or permitted prior to the effective date of the ordinance codified in this chapter are not subject to the requirements of this chapter unless physical modifications or alterations are undertaken that materially change the size, type, or components of a system in such a way as to require new permitting. Routine operation and maintenance or like-kind replacements shall not require a permit.

C.    Consistent with Government Code Section 65850.7, the electric vehicle charging station permit shall not be conditioned on the approval of such a station by an association, as that term is defined by Civil Code Section 4080. (Ord. 1278 § 2 (part), 2017)

14.35.030 Definitions.

For purposes of this chapter, the following terms shall have the meaning set forth in this section:

A.    “Building division” means the building division of the community development department of the city of Folsom.

B.    “Chief building official” means the chief building official of the city of Folsom or his/her designee.

C.    “Checklist” means a checklist developed and approved by the chief building official for processing the permit application under this chapter.

D.    “Electric vehicle charging station” means any level of electric vehicle supply equipment station that is designed and built in compliance with Article 625 of the California Electrical Code, and delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle.

E.    “Specific, adverse impact” means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified, and written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete. (Ord. 1278 § 2 (part), 2017)

14.35.040 Application requirements—Permit review—Use permit.

A.    A permit application that satisfies the information requirements in the application checklist shall be deemed complete by the building division and be promptly processed. Upon confirmation by the chief building official that the permit application and supporting documents are complete and meet the requirements of the application checklist, and that the application is consistent with all applicable laws, the chief building official shall administratively approve the application and issue all necessary permits. Such approval does not authorize an applicant to energize or utilize the electric vehicle charging station until approval is granted by the city. If the chief building official determines that the permit application is incomplete, he or she shall issue a written correction notice to the applicant, detailing all deficiencies in the application and any additional information required to be eligible for expedited permit issuance.

B.    Review of the application to install an electric vehicle charging station shall be limited to the chief building official’s review of whether it meets all health and safety requirements of local, state and federal law.

C.    If the chief building official makes a finding based on substantial evidence that the electric vehicle charging station could have a specific adverse impact upon the public health or safety, the city may require the applicant to apply for a use permit. (Ord. 1278 § 2 (part), 2017)

14.35.050 Fees.

The city council may establish, by resolution, an application processing fee for the permitting of electrical vehicle charging stations. (Ord. 1278 § 2 (part), 2017)
