10.28.010 Applicability of chapter.

The provisions of this chapter prohibiting the stopping, standing, or parking of a vehicle shall apply at all times or at those times specified in this chapter, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic-control device. 10.28.020 Parking for repairs or washing prohibited.

No person shall park a vehicle upon any roadway for the principal purpose of washing, greasing, or repairing such vehicle except repair necessitated by emergency. (Ord. 333 § 3242, 1973).

10.28.030 Angle parking.

A. Whenever this title designates or describes or whenever the city council by ordinance or resolution designates or describes any street or portion thereof upon which angle parking shall be permitted, the city traffic engineer shall mark or sign such street indicating the angle at which vehicles shall be parked.

B. When signs or markings are in place indicating angle parking as provided in this chapter, no person shall park or stand a vehicle other than at the angle to the curb or edge of the roadway indicated by such signs or markings. (Ord. 333 § 3243, 1973).

10.28.040 Restrictions on parking within designated preferential parking areas.

No person shall stop, stand, or park a vehicle on any street within an area designated by a resolution of the city council as a preferential parking area, when authorized signs are in place, on the days and during the hours set forth in the resolution of the city council except:

A. A vehicle registered to or controlled and exclusively used by a person residing or employed in the designated preferential parking area when such vehicle properly displays a valid preferential parking permit.

B. The following additional vehicles, which shall be exempt from parking restrictions applicable to preferential parking areas:

1. An emergency vehicle, including but not limited to an ambulance, fire engine or police vehicle;

2. A vehicle that is under the control of a person providing services to a real property located in a designated preferential parking area, including but not limited to a delivery vehicle; and

3. A vehicle registered to or used by disabled persons when such vehicle displays a distinguishing license plate or placard issued by the California Department of Motor Vehicles.

The fee for the issuance of preferential parking permits shall be set forth in the resolution establishing fees and charges for the city of Fortuna. (Ord. 2010-684 § 2; Ord. 94-594 § 1; Ord. 333 § 3245, 1973).

10.28.050 Narrow streets.

A. The city traffic engineer is authorized to place signs or markings indicating no parking upon any street when the width of the roadway does not exceed 20 feet, or upon one side of a street as indicated by such signs or markings when the width of a roadway does not exceed 30 feet.

B. When official signs or markings prohibiting parking are erected upon narrow streets as authorized in this section, no person shall park a vehicle upon any such street in violation of any such sign or marking. (Ord. 333 § 3246, 1973).

10.28.060 Stopping or parking – Prohibited places.

The city traffic engineer shall appropriately sign or mark the following places and when so signed or marked no person shall stop, stand, or park a vehicle in any of said places:

A. At any place within 12 feet of an intersection in any business district except that a bus may stop at a designated bus stop;

B. Within 12 feet of the approach to any traffic signal, boulevard stop sign, or official electric flashing device;

C. At any place where the city traffic engineer determines that it is necessary in order to eliminate unusual traffic hazards. (Ord. 333 § 3247, 1973).

10.28.070 Peddlers, vendors, taxis – Parking permits – Restrictions.

A. Except as otherwise provided in this section, no person shall stand or park any vehicle, wagon, or pushcart from which services, goods, wares, merchandise, fruits, vegetables, or foodstuffs are sold, displayed, solicited, or offered for sale or bartered or exchanged, or any lunch wagon or eating car or vehicle on any portion of any street within the city, except that such vehicles, wagons, or pushcarts may stand or park at the curb or on the shoulder only at the request of a bona fide purchaser for a period of time not to exceed 10 minutes at any one place. The provisions of this subsection shall not apply to persons delivering such articles upon order of, or by agreement with, a customer from a store or other fixed place of business or distribution.

B. No person shall park or stand, for more than 10 minutes on any street, any lunch wagon, eating cart or vehicle, or pushcart from which peanuts, popcorn, candy or other articles of food are sold or offered for sale without first obtaining a food vendor’s permit to do so from the zoning administrator who shall designate the specific location in which such cart shall stand.

C. No person shall park or stand any vehicle or wagon used or intended to be used in the transportation of property for hire on any street while awaiting patronage for such vehicle or wagon without first obtaining a written permit to do so from the city council which shall designate the specific location where such vehicle may stand.

D. Whenever any permit is granted under the provisions of this section and a particular location to park or stand is specified therein, no person or food vendor shall park or stand any vehicle, wagon, or pushcart on any location other than as designated in such permit. In the event that the holder of any such permit is convicted in any court of competent jurisdiction for violating any of the provisions of this section, such permit shall be forthwith revoked by the city council upon the filing of the record of such conviction with the city council, and no permit shall thereafter be issued to such person until six months have elapsed from the date of such revocation. 10.28.080 Temporary emergencies.

A. Whenever the city traffic engineer determines that an emergency traffic congestion is likely to result from the holding of public or private assemblages, gatherings, or functions, or for other reasons, the city traffic engineer shall have the power and authority to order temporary signs to be erected or posted indicating that the operation, parking, or standing of vehicles is prohibited on such streets and alleys as the city traffic engineer shall direct during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency and the city traffic engineer shall cause such signs to be removed promptly thereafter.

B. When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park, or stand any vehicle contrary to the directions and provisions of such signs. (Ord. 333 § 3249, 1973).

10.28.090 Time zones.

A. The city engineer is authorized to determine and mark time-zone parking areas at any place within the city, limiting the time a vehicle may remain parked in the zone.

B. Any such time zones shall be clearly marked by signs indicating the area of the zone and the period of time allowed for parking within the zone.

C. When signs authorized by the provisions of this section are in place giving notice thereof, no person shall park or stand any vehicle contrary to the directions and provisions of such signs. The police department may issue special parking permits that exempt residents from the time-zone parking restrictions.

D. It is unlawful and considered an infraction for any person to cause, allow or permit any vehicle to park for an amount of time exceeding the amount of time posted in a time-zone parking area.

E. Fines provided for in this section shall be as from time to time set by resolution of the city council.

F. Time-zone parking shall be enforced as stated on the sign except on the following holidays: New Years, Labor Day, Admission Day, Veterans Day, Thanksgiving and Christmas. (Ord. 94-594 § 2; Ord. 92-572 § 2; Ord. 91-563 § 2; Ord. 87-521; Ord. 333 § 3250, 1973).

10.28.100 Seventy-two-hour parking.

It shall be unlawful for any vehicle to be parked on any street or alley for 72 or more consecutive hours. Any such vehicle parked or left standing in violation of this section may be removed by order of a city police officer. (Ord. 87-510 § 1).

10.28.110 Truck parking prohibitions.

A. Park Street. No commercial truck tractor, commercial trailer, commercial semitrailer or any combination thereof shall be permitted to park on Park Street and the parking lot for the Fireman’s Pavilion. (Ord. 2001-631 § 2).
