18.28.010 Home business zone (H-B).

The H-B zone is intended to permit business and industrial uses of limited size and intensity to be located on lots occupied by single-family residential structures. It is further intended that where there are existing residential structures on a lot, the character of H-B zoned areas be maintained by restricting nonresidential uses to a separate building or area located to the rear of such residential structures. 18.28.020 Uses permitted.

The following uses shall be permitted in the H-B zone:

A. Single-family dwellings;

B. Home occupations subject to the provisions of Chapter 18.56 of this code;

C. Mobile homes certified under the National Mobile Home Construction and Safety Standards Act of 1974 (42 U.S.C. Section 5401 et seq.) on a foundation system, pursuant to Section 18551 of the Health and Safety Code of the state. Further, such mobile homes shall be occupied only as a residential use type and shall be subject to any and all property development standards of the zone; and

D. Family day care homes; provided, a large family day care home shall be permitted subject to approval of a home occupation permit pursuant to Chapter 18.56 of this code. (Prior code § 10-3.1402)

18.28.030 Uses permitted subject to a conditional use permit.

The following uses may be permitted subject to the issuance of a conditional use permit pursuant to the provisions set forth in Chapter 18.46 of this code:

A. Plant nurseries;

B. Television, appliance, radio, and small equipment repairs, but excluding the retail sales of repaired products;

C. Contractor businesses;

D. Machine shops;

E. Retail sales of products produced on the premises;

F. Printing, engraving, lithographing, blueprinting, photocopying, and film processing;

G. Data processing and research, development or experimental laboratories;

H. Dog kennels for the purpose of breeding, training, boarding, or raising for profit or pleasure in the area bounded by 178th Street on the north, 182nd Street on the south, Denker Avenue on the east, and the alley between La Salle Avenue and Harvard Boulevard on the west;

I. Light manufacturing, processing or assembly of goods;

J. (Repealed);

18.28.040 Uses prohibited.

The following uses are deemed to be incompatible with the uses set forth in Sections 18.28.020 and 18.28.030 and are therefore prohibited:

A. Automobile repair facilities;

B. Multifamily dwellings containing two or more dwelling units;

C. Hotels, motels, and lodginghouses;

D. Retail commercial uses, except as provided in subsection E of Section 18.28.030;

E. Lodges, meeting halls and other places of public assembly;

F. (Deleted);

G. Warehouses and truck terminals;

H. Intensive commercial and industrial uses;

I. Adult-oriented businesses as defined by Section 18.62.020G of this code;

J. It is unlawful to sell, contract to sell, offer to sell, display for the purpose of sale, or permit the sale of any vehicle from a vacant or unimproved lot. “Vehicle,” as used in this subsection, means and includes everything so defined in the Vehicle Code of the state and, in addition, boats;

K. Automobile service stations;

L. Home sharing rentals;

M. Short-term rentals; and

N. Uses other than those specifically set forth or provided for in Sections 18.28.020 and 18.28.030, except those determined to be similar pursuant to the provisions of Section 18.42.040. 18.28.050 Property development standards.

The following property development standards shall apply to all land and buildings in the H-B zone:

A. Lot dimensions: each lot shall have a minimum width at the building line of fifty feet and a minimum area of five thousand square feet.

B. Building height: no building shall exceed thirty-five feet in height. Single-family residences shall not exceed twenty-five feet or two stories in height.

C. Yards: every lot shall have a front yard setback of not less than twenty feet in depth. Structures in the front one-half of the lot shall be located not closer than five feet from the side property line.

D. Lot area per dwelling unit: the minimum lot area per dwelling unit shall be five thousand square feet.

E. Minimum size of dwelling units: each dwelling unit shall contain a minimum of eight hundred square feet of enclosed floor area, excluding garages.

F. All nonresidential uses and structures shall be confined to the rear one-half of the lot.

G. All nonresidential activities shall be conducted within a building. Outside storage shall be enclosed by a solid, uniformly finished fence and/or masonry wall. Such fence or wall shall be at least eight feet in height. The storage of materials shall not exceed the height of the required fence or wall.

H. Signs: the provisions of Chapter 18.58 of this code shall apply.

I. Off-street parking and loading: the provisions of Chapter 18.40 of this code shall apply.

J. Off-street parking in setback areas: required off-street parking spaces, if approved by the commission, may be located within the front yard setback area of a lot. In no case shall commercial or industrial vehicles or equipment be parked or stored in the required front yard setback area.

K. Fences, hedges and walls: the provisions of Section 18.42.070 of this code shall apply.

L. The gross floor area of buildings or structures on a lot or lots that comprise a project site shall not exceed 0.50 FAR. (Ord. 1683 § 31, 2006; Urg. Ord. 1682; prior code § 10-3.1405)

18.28.060 Performance standards.

A. Fire and Explosion Hazards. All activities involving the use and storage of inflammable and explosive materials shall be governed by the provisions of the fire prevention code of the city. Adequate safety devices and equipment against the hazard of fire and explosion shall be provided in accordance with the fire prevention code. All incineration shall be prohibited.

B. Noise emitted from any use shall not exceed standards set forth in Chapter 8.36. (Ord. 1683 § 32, 2006; Urg. Ord. 1682; prior code § 10-3.1406)

18.28.070 General provisions and exceptions.

A. Where two or more adjoining lots of record are in single ownership at the time such lots are zoned H-B and such lots individually are substandard in lot width and/or lot area, such lots shall be considered a single lot or several lots which meet the minimum width and area requirements set forth in Section 18.28.050A.

B. A building containing any nonresidential use specified in Section 18.28.030, subject to conditional use permit approval, may be constructed on the front one-half of a vacant lot provided the property development and performance standards are complied with and provided, further, the exterior appearance of such building shall be residential in character.
