6.16.010:    Curfew

6.16.010 CURFEW:

A.    Findings And Declarations: The city council finds and determines that it is in the best interest of members of this community to establish a curfew as set forth in this section to prevent minors under the age of eighteen (18) years from becoming victims or participants in street gangs and gang related activities. It is the intent of the city council to allow minors under the age of eighteen (18) years to move about freely while participating in legitimate activities, and to pursue legitimate activities during the hours specified in subsection B of this section with the permission of his or her parent, guardian, or other adult person having the lawful care and custody of the minor. B.    Age And Hour Restrictions: It is unlawful for any minor under the age of eighteen (18) years to remain in or upon the public streets, sidewalks, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, or vacant lots between the hours of ten o’clock (10:00) P.M. and five o’clock (5:00) A.M. of the following day. (1972 Code § 9.50.030)

C.    Exceptions: The restrictions set forth in subsection B of this section shall not apply to the following:

1.    A minor accompanied by his or her parent, guardian, or other adult person having the lawful care and custody of the minor;

2.    A minor returning directly home from a meeting, entertainment, recreational activity, or dance;

3.    A minor in a motor vehicle involved in interstate travel;

4.    A minor engaged in legitimate activities relating to employment;

5.    A minor exercising rights protected by the first amendment of the United States constitution, such as the free exercise of religion, freedom of speech, and the right of assembly. (1972 Code § 9.50.035)

D.    Violation: Any minor violating the provisions of this section shall be dealt with in accordance with the juvenile court laws of the state. (1972 Code § 9.50.040)
