LOITERING OF AND CURFEW FOR MINORS

9.60.010 Loitering of minors prohibited.

A.    It shall be unlawful for any person under eighteen years of age to loiter, idle, wander, play, be or remain in or upon the public streets, highways, roads, alleys, parks, playgrounds or other public grounds, public places or public buildings or in or upon any place open to the public, including privately owned or private vacant buildings or any unsupervised place either on foot or in a vehicle, between the hours of ten p.m. and daylight on the following day, Pacific Standard or Pacific Daylight Time.

B.    The provisions of this section do not apply to the following persons:

1.    A person accompanied by his or her parent, guardian or other adult person having the lawful care and custody of the person;

2.    A person returning directly home from a meeting, entertainment or recreational activity;

3.    A person upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the lawful care and custody of the person; or

4.    A person in lawful employment which makes it necessary to be in such place. (Ord. 369 §1(Exh. A) (part), 1992: Ord. 86 §1, 1964).

9.60.020 Responsibility of parents.

A.    It shall be unlawful for the parent, guardian or other adult person having the lawful care and custody of a person under eighteen years of age to knowingly permit such person to loiter, idle, wander or play, be or remain in or upon the public streets, highways, roads, alleys, parks, playgrounds or other public grounds, public places or public buildings, or in or upon any place open to the public, including privately owned property open to public use, or in or upon private vacant lots or private vacant buildings, or any unsupervised place either on foot or in a vehicle, between the hours of ten p.m. and daylight of the following day, Pacific Standard or Pacific Daylight Time.

B.    The provisions of this section do not apply when the person under eighteen years of age is either:

1.    Accompanied by his or her parent, guardian or other adult person having the lawful care and custody of the person;

2.    Returning directly home from a meeting, entertainment or recreational activity;

3.    Upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the lawful care and custody of the person; or

4.    In lawful employment which makes it necessary to be in such place. (Ord. 369 §1(Exh. A) (part), 1992).

9.60.030 Penalty for violation:

A.    Any minor violating the provisions of Section 9.60.010 shall be dealt with in accordance with the Juvenile Court Laws of the state of California.

B.    Any parent, guardian or other adult person having the lawful care and custody of a person under eighteen years of age violating any provisions of this chapter is guilty of a misdemeanor. (Ord. 369 §1(Exh. A)(part), 1992).
