HOTEL BUSINESS IMPROVEMENT DISTRICT

3.100.010 Created.

A.    A parking and business improvement area is hereby established and is called the “Half Moon Bay Hotel Business Improvement District.”

B.    The boundaries of the district shall include the city limits of the city of Half Moon Bay and those certain commercial lodging facilities located in the unincorporated territory of the county of San Mateo identified on Resolution 2016-92.

C.    The businesses in the district established by this ordinance shall be subject to this chapter and to any amendments to Part 6 of Division 18 of the California Streets and Highways Code, commencing with Section 36500.  (Ord. C-2016-06 §1, 2016; Ord. C-2-04 §1(part), 2004).

3.100.020 Assessments.

A.    The assessments shall be levied annually on all hotels, including, but not limited to, hotels, motels, inns, and bed and breakfasts existing now or in the future, within the boundaries of the district as set forth in Section 3.100.010(B).

B.    The assessment from the funds levied by the businesses shall be used to promote lodging at the hotels within the district, administer marketing programs that increase overnight lodging and to fund related activities, staffing and administration for the district.  The revenue of the levy from assessments shall not be used to provide improvement or activities outside the district or for any purpose other than the purposes specified in the resolution of intention, as modified by the city council at the hearing concerning the establishment of the district.

C.    The assessment to be levied will benefit the businesses in the district by collecting funds for advertising, promoting overnight lodging, and supporting the operation of a visitor center.  (Ord. C-2016-06 §2, 2016; Ord. C-2-04 §1(part), 2004).

3.100.030 Administration.

A.    The funds will be collected by the city of Half Moon Bay on the same schedule as, but independently from, the collection of transient occupancy taxes.  Funds shall be allocated quarterly from the city to the district within thirty days of collection.

B.    The cost to establish the district shall be paid by the Half Moon Bay Coastside Chamber of Commerce and Visitors’ Bureau and will be reimbursed by funds from the district.

C.    The Half Moon Bay Coastside Chamber of Commerce and Visitor Center is designated as the managing agency for district-related activities, staffing and administration.

D.    The Half Moon Bay city council hereby appoints an advisory committee consisting of, but not limited to, one representative from each of the hotels, the managing director of the Half Moon Bay Coastside Chamber of Commerce and Visitor Center, and one representative from the Chamber of Commerce board of directors.  (Ord.
