Chapter 2. Park and Open Space Closure

Sec. 11-2.01 Parks and City Open Space Closed During Certain Periods of Time.

(a) City parks and City open space areas shall be closed to the public during the following periods of time as set forth herein:

All City parks and City open space areas shall be closed to the public from thirty (30) minutes after sunset until sunrise of the following day.

(b) Any person using any City park or City open space during such closure periods is guilty of a trespass pursuant to the provisions of California Government Code Section 37359. (Ord. 493 § 3 (part), 2016: Ord. 413 § 1, 2006: Ord. 268 Div. I (part), 1987)

Sec. 11-2.02 Penalties for Violation.

Any person violating any of the provisions of this Chapter is guilty of an infraction and, upon conviction thereof, shall be punished by a fine of not more than one hundred dollars ($100.00), and for a second conviction within a period of one (1) year by a fine not exceeding two hundred dollars ($200.00), and for a third or any subsequent conviction within a period of one (1) year by a fine not exceeding five hundred dollars ($500.00). The penalties herein are not exclusive, so that a person violating any of the provisions of this Chapter is subject to any other applicable fines and penalties, including but not limited to civil penalties and administrative citations.
