6.45.010 Incorporation of recitals.
The recitals set forth in the ordinance codified in this chapter are made findings and determinations of the board and are incorporated herein and made an operative part of this chapter. [Ord. 91 § 3, 2024; Ord. 85 § 1, 2016].
6.45.020 Sewer service fees.
A. The rate structure for the sewer service fees is comprised of four customer classes: single-family residential, multifamily residential, mobile homes, and nonresidential (e.g., commercial and industrial). The rates are hereby established on the basis of the number of equivalent dwelling units (“EDUs”) assigned to a customer’s account. An EDU compares the flows generated by each property to those generated by an average single-family residential property. A single-family residential property shall be assigned one EDU with an estimated wastewater flow of 175 gallons per day. The number of EDUs assigned to an account shall be based on the estimated wastewater flow generated by that account divided by the single-family residential flow rate. The basis for the calculation of the number of units assigned to each customer class is shown in the table below.

B. The board hereby adopts the monthly sewer service fees in the amounts, at the rates, and on the effective dates as set forth in the table below.

C. The sewer service fees adopted herein shall be imposed on any property owner or tenant directly liable for the payment of the sewer service fees after the property is connected to the wastewater system. [Ord. 91 § 3, 2024; Ord. 85 § 2, 2016].
6.45.030 Authorization.
The general manager is hereby authorized and directed to take all actions necessary to implement and collect the sewer service fees set forth herein. [Ord. 91 § 3, 2024; Ord. 85 § 3, 2016].
6.45.040 Method of collection of sewer service fees and charges.
It is the intention of the board to take all actions necessary to collect all fees and charges for sewer service on the tax roll in the same manner and at the same time as the general taxes of the district pursuant to Health and Safety Code Section 5473. Notwithstanding, the district may, in the alternative or in the event a majority protest precludes the district from collecting such fees and charges on the tax roll, collect fees and charges for sewer service on the customer’s monthly water bill pursuant to Water Code Section 31102, or by any other legally available means. In the event a customer fails to pay all or any part of a bill, the district may pursue any remedies available in law or equity, including, but not limited to, placing the delinquent amount on the tax roll or discontinuing any and all service for which the unpaid bill was rendered.
