8.08.010 Findings and purpose.

The council finds and declares as follows:

A. Containers utilizing petroleum-based polystyrene plastic which is nonbiodegradable and nonrecyclable are increasingly being used for packaging and transporting products by the food-service industry;

B. Chlorofluorocarbons are the most common chemical agent utilized to blow, and expand, polystyrene plastic material;

C. The city, in order to protect the environment, the health of its citizens, and conserve landfill space, by this chapter intends to prohibit the manufacture, sale, and distribution of polystyrene containers;

D. The people and the city support international, federal, and state bans on all uses of chlorofluorocarbon not deemed absolutely essential. Until such bans take place, reducing chlorofluorocarbon use and alerting the public to the possible dangers must occur at the local level. (Ord. 32 § 1, 1988)

8.08.020 Definitions.

As used in this chapter:

“Chlorofluorocarbons (CFC’s)” are substances containing carbon, fluorine, and chlorine.

“Polystyrene (CFC-processed) food packaging” means a thermoplastic petrochemical material used for packaging and containing food and drink materials, including, but not limited to, cups, bowls, plates, trays, cartons, and hinge carry-out containers, and stock food crates.

“Polystyrene plastic” is a thermoplastic petrochemical material.

“Take-out food” means food or beverages requiring no further preparation to be consumed and which are purchased primarily in order to be consumed off vendor’s premises. (Ord. 32 § 2, 1988)

8.08.030 Take-out food vendors – Prohibited food packaging.

No take-out food vendor shall purchase, obtain, sell, manufacture, distribute, or provide to customers, or otherwise use in its business, any product made of, or with, polystyrene (CFC-processed) plastic on or after January 1, 1989. (Ord. 32 § 3, 1988)

8.08.040 Violation – Penalty.

Repealed by Ord. 370. (Ord. 32 § 4, 1988)
