RIGHTS OF TENANTS AFFECTED BY CONDOMINIUM CONVERSION

16.60.010 Purpose.

The tenants of rental properties which are converted to condominiums normally have such tenancy involuntarily terminated. This involuntary termination may tend to disrupt settled tenants, therefore it shall be the purpose of this chapter to give to such tenants limited rights in order to reduce the disruptive effect of a conversion of the rental property to a condominium. (Ord. 368 § 4, 1981).

16.60.020 Notice of intent.

A. A notice of intent to convert, in accordance with California Government Code, Section 66427.1(b), shall be delivered to each tenant prior to submission of the tentative map to the city planning commission, and shall give to each tenant who is not in default under the rental agreement 120 days of continuing tenancy from the date of approval of the final subdivision map to find substitute housing and to relocate.

B. A notice of right to contract for the purchase of a unit, in accordance with California Government Code, Section 66427.1(b), shall be given to each tenant within 10 days of approval of the conversion permit by the city council. The right to contract for purchase shall remain a right of each tenant for 120 days from the date the first unit is offered to the public for sale, unless such right is voluntarily waived by the tenant. 16.60.030 No increase in rent.

A tenant’s rent shall not be increased for two years from the time of filing the condominium conversion application. This moratorium on rent increase shall be removed in the event the application is disapproved, the subdivider notifies the city that the requested conversion is cancelled, or upon approval of the city council. (Ord. 368 § 4, 1981).

16.60.040 Relocation allowance.

The subdivider shall provide relocation equal to one and one-half times the monthly rent to any tenant household living in any unit at any time prior to tentative map approval, provided such tenant is not otherwise in default of the rental agreement. (Ord. 368 § 4, 1981).

16.60.050 Senior citizens.

All tenant households in which at least the head of household or spouse is 60 or older, at the time of the final map approval, shall be offered a lifetime lease. Reasonable annual rent increases shall be allowed, but they shall not exceed the increase in the consumer price index for the preceding 12 months. (Ord. 368 § 4, 1981).
