12.04.010 Definitions.

The following words and phrases, whenever used in this title, shall be construed as defined in this chapter, unless from the context a different meaning is intended or unless a different meaning is specifically defined and more particularly directed to the use of such words and phrases:

A. “Applicant” means any person applying for the written permit of the director as provided for in this title.

B. “Clerk” means the city clerk of Hughson.

C. “Commission” means the Public Utilities Commission of the state of California.

D. “Director” means the director of public works of Hughson.

E. “New or different use” means a change in use of an existing installation or structure constituting a substantially increased burden upon a city street or public place.

F. “Permittee” means any person who shall have received the written permit of the director as provided for in this title.

G. “Person” shall have the meaning established in HMC 1.04.010(J), and shall include additionally any improvement, water, sanitary, irrigation or other public district.

H. “Poles, overhead wires and associated overhead structures” means poles, towers, supports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers, insulators, cutouts, switches, communication circuits, appliances, attachments and appurtenances located above ground within a district and used or useful in supplying electric, communication or similar or associated service, excepting those that may be owned, controlled or operated by an irrigation district.

I. “Underground utility district” or “district” means that area in the city within which poles, overhead wires and associated overhead structures are prohibited as such area is described in a resolution adopted pursuant to the provisions of Chapter 12.20 HMC.

J. “Utility” shall include all persons or entities supplying electric, communication or similar or associated service by means of electrical materials or devices, but shall exclude the Turlock Irrigation District and the Modesto Irrigation District.

K. “Workday” shall mean every day other than a Saturday, Sunday or legal holiday. (Ord. 91-05 § 3, 1991)
