8-10.010 Declaration of purpose and findings.

A.    The purpose of this chapter is: (1) to promote the public peace, health, safety, and welfare by establishing rules and regulations for the use and enjoyment of the city skateboard park, which is designed and maintained for the purpose of recreational skateboard and rollerskate use only; and (2) to comply with California Health and Safety Code Section 115800 by requiring the posting of signs at the skateboard park affording reasonable notice that any person riding a skateboard at the skateboard park must wear a helmet, elbow pads, and knee pads, and that any person failing to do so will be subject to citation.

B.    The city skateboard park is an unsupervised facility. Because of the particular design features of the skateboard park, skateboarding and rollerskating at the skateboard park are considered stunt, trick, or luge skateboarding and rollerskating, and constitute hazardous recreational activities. All persons who use the skateboard park do so at their own risk.

8-10.020 Definitions.

As used in this chapter:

“Alcoholic beverages” means alcohol, spirits, liquor, wine, beer, and every liquid or solid containing one-half of one percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed, or combined with other substances.

“Director” means the Community Services Director, the Community Services Director’s designee, the Deputy City Manager, or the Deputy City Manager’s designee.

“Eviction” means expulsion from the skateboard park.

“Laguna Hills Community Center and Sports Complex” means the Laguna Hills Community Center building, adjacent athletic fields and courts, and related park amenities located at 25555 Alicia Parkway, Laguna Hills.

“Roller hockey rink” means the roller hockey rink facility located within the Laguna Hills Community Center and Sports Complex at 25555 Alicia Parkway, Laguna Hills.

“Rollerskate” means any footwear, or device which may be attached to the foot or footwear, to which wheels are attached and such wheels may be used to aid the wearer in moving or propulsion, including but not limited to in-line skates commonly known as rollerblades.

“Scooter” means any foot-operated device consisting of a narrow footboard mounted between two wheels in tandem with an upright steering handle attached to the front wheel, which is propelled by human, gravitational power, or mechanical energy, commonly known as razor or kick scooters.

“Skate” or “skating” means to ride, operate, or use a skateboard or rollerskates.

“Skate area” means the paved surfaces, obstacles, and features of the skateboard park specifically designed for skating, including platforms, transitions, banks, bowls, hips, ledges, coping, decking, rails, flat bars, stairs, and adjacent concrete surfaces, but excluding the picnic tables, public restrooms, and pathway linking the Laguna Hills Community Center and Sports Complex parking lot to the roller hockey rink.

“Skateboard” means a board of any material, which has wheels attached to it and which is propelled or moved by human, gravitational power, or mechanical energy and to which there is not fixed any device or mechanism to turn or control the wheels.

“Skateboard park” means the city of Laguna Hills Skateboard Park located within the Laguna Hills Community Center and Sports Complex at 25555 Alicia Parkway, Laguna Hills.

“Smoking” means inhaling, exhaling, burning, or carrying any lighted cigarette, cigar, pipe, operating electronic cigarette, weed, plant, or other combustible substance in any manner or in any form. (Ord. 2015-5 § 1 (part))

8-10.030 Hours.

A.    The hours of operation for the skateboard park are from eight a.m. to ten p.m. Monday through Saturday, and eight a.m. to six p.m. on Sundays. Use of the skateboard park outside of the hours of operation is prohibited. In addition, use of the skateboard park after sundown when the skateboard park lights are not on is prohibited. The skateboard park hours of operation shall be displayed on the signage posted in accordance with Section 8-10.050.

B.    The Director may, in his or her sole discretion, regulate the hours of operation at the skateboard park for specified groups of users. The city shall post such regulations, if any, on appropriate signage at the skateboard park.

8-10.040 Skateboard park rules and regulations.

The following rules and regulations shall apply to the skateboard park:

A.    No person shall enter or be upon the skateboard park at any time other than the established and posted hours of operation, after sundown when the facility lights are off, or at any time when the Director has closed the skateboard park.

B.    No person shall ride, operate, or use any device other than skateboards or rollerskates in the skate area. Bicycles, scooters, motorized vehicles, and all other uses and devices are prohibited at the skateboard park.

C.    Pursuant to California Health and Safety Code Section 115800(b), all persons riding a skateboard or rollerskates at the skateboard park facility shall wear a helmet, elbow pads, and knee pads.

D.    A properly fitted and fastened helmet, elbow pads, and knee pads shall be worn at all times by all persons in the skate area, including those times when a person is not actively skating.

E.    Spectators are not allowed in the skate area. No person shall enter or be upon the skate area for any purpose other than skating.

F.    The skateboard park is designed for use without the introduction of any outside obstacles, ramps, rails, or other similar materials or devices. No person shall place, position, erect, or use any outside equipment, obstacles, ramps, rails, or other similar materials or devices at the skateboard park.

G.    Except for recreation instructors employed or contracted by the city, no person or group shall provide instruction, coaching, or teaching of skateboarding or rollerskating at the skateboard park for any fee or compensation. No person shall pay another person at the skateboard park for instruction, coaching, or teaching.

H.    Any person who is injured at the skateboard park shall report the injury to city personnel and shall complete an injury report form.

I.    No person shall skate when the skate area surface is wet or other conditions exist that could adversely affect the safety of persons skating.

J.    The use of profanity is prohibited.

K.    Food and beverages are prohibited within the skate area.

L.    Glass products, glass bottles, glass beverage containers, and any other type of glass object or material are prohibited.

M.    The skateboard park is a smoke-free area. Smoking is prohibited. Additionally, the use of smokeless tobacco is prohibited.

N.    Alcoholic beverages are prohibited.

8-10.050 Posting of signs required – Content.

Signs shall be posted in one or more conspicuous and visible area(s) at the skateboard park to afford reasonable notice of the provisions of this chapter, and that pursuant to California Health and Safety Code Section 115800, any person riding a skateboard or rollerskating at the skateboard park facility must wear a helmet, elbow pads, and knee pads, and that any person failing to do so shall be subject to citation. 8-10.060 Effect, enforcement, and penalties.

A.    Conditioned Use of the Skateboard Park. The privilege of any person to use the skateboard park is expressly conditioned upon compliance by that person with the provisions of this chapter as they apply to such use. It is unlawful and subject to punishment in accordance with Chapter 1-32 for any person to violate or fail to comply with any provision of this chapter.

B.    Eviction. Any violation of any provision of this chapter shall subject the violator to immediate eviction from the skateboard park and/or citation and prosecution.
