PROHIBITING STORAGE OF HAZARDOUS SUBSTANCES AND MATERIALS AND THE PARKING OF VEHICLES TRANSPORTING HAZARDOUS SUBSTANCES OR MATERIALS IN RESIDENTIAL NEIGHBORHOODS

8.56.010 Definitions.

“Hazardous substance and material” shall be defined as any substance or material which is toxic, corrosive, flammable, an irritant, a strong sensitizer, which generates pressure through decomposition, heat or other means, if such a substance or material may cause substantial personal injury, serious illness or harm to wildlife, during, or as a proximate result of, any leakage or dispersal of such substances or materials.

“Toxic,” “corrosive,” “flammable,” “irritant,” and “strong sensitizer” shall be given the same meaning as in the California Hazardous Substances Act, Chapter 13 (commencing with Section 28740) of Division 21. [Ord. 739 § 1, 1985].

8.56.020 Unlawful storage.

A. No person, firm or corporation shall store, park, or leave unattended any vehicle containing hazardous substances, materials or residuals within any residential neighborhood of the City of Lake Elsinore as delineated on the City’s General Plan.

B. No person, firm or corporation shall store any 50-gallon drums containing hazardous substances or materials within any residential neighborhood in the City of Lake Elsinore as delineated on the City’s General Plan. [Ord. 739 § 1, 1985].

8.56.030 Unlawful transportation.

No person, firm or corporation shall transport any hazardous substances or materials through any residential neighborhood within the City of Lake Elsinore as delineated on the City’s General Plan. [Ord. 739 § 1, 1985].

8.56.035 Unlawful disposal.

It shall be unlawful for any person, firm or corporation to dispose of any hazardous substances, materials or residuals within the City limits of the City of Lake Elsinore. [Ord. 828 § 2, 1988].

8.56.040 Enforcement.

It shall be the duty of all peace officers, law enforcement officers and Code Enforcement Officers to enforce the provisions of this chapter and, unless otherwise prohibited by law, shall be empowered to assure compliance with all provisions herein and have the right to enter free of charge, at any time, upon any place or parcel of land, to investigate and determine compliance and/or to enforce and perform all the regulatory provisions of this chapter. 8.56.050 Violation – Penalty.
