9.25.010 Purpose.

Individuals are presently engaged in the unregulated operation of motorcycles, motor-driven cycles, and similar off-highway vehicles on public and private property throughout the city of Lakeport. The driving, riding and use of motorcycles, motor-driven cycles, or off-highway motor vehicles on public and private property within the limits of the city is and can be the cause of noise, dust, erosion, sedimentation, degradation of water quality, destruction of view and the destruction of plants, landscaping and other personal and real property which adversely affects the comfort, enjoyment and privacy of occupants and residents of the city. 9.25.020 Violation.

It is unlawful for any person to operate any motorcycle, motor-driven cycle, or similar off-highway vehicle on any real property in the city limits of Lakeport, public or private, other than public roads or property otherwise approved for recreational use of this type by ordinance or by exemption by this code. (Ord. 879 §1(part), 2009)

9.25.030 Exemptions.

The provisions of this chapter shall not apply to:

A.    Owners, tenants, their invitees, or lawful occupants of real property and members of their immediate family while operating such vehicles upon their property for necessary use in the course of a lawful occupation for profit or gain, or other similar nonrecreational purpose.

B.    An event sanctioned by the city of Lakeport. (Ord. 879 §1(part), 2009)

9.25.040 Enforcement and penalties.

A.    Enforcement of this chapter shall be implemented by the chief of police or his/her designee.

B.    A violation of this chapter is an infraction, which shall be subject to a fine of not more than one hundred dollars for the first offense nor more than five hundred dollars for each subsequent offense. (Ord. 879 §1(part), 2009)
