12.16.010 Residential property--Unauthorized distribution of materials prohibited.

It is unlawful for any person, firm or corporation, or any agent or employee of any person, firm or corporation to throw into, leave upon, or scatter onto any residential property in the city, without the written consent of the owner thereof, or his agent, or the occupant of the private property, any newspaper, handbill, pamphlet, circular, dodger or any advertising sheet or material devised or intended to promote any commercial or moneymaking activity. 12.16.020 Public ways--Distribution restricted.

It is unlawful for any person, firm or corporation, or any agent or employee of any person, firm or corporation to drop, scatter or place on or upon any public street or any sidewalk, or to place in or on any vehicle parked in or upon any public way without the consent of the owner thereof, any newspaper, handbill, pamphlet, circular, dodger or any other advertising sheet or matter devised or intended to promote in whole or in part any commercial or moneymaking activity; provided, that this section shall not be construed as preventing the giving away or sale of any newspaper or written graphic material to any person willing to acquire same, or the display of newspapers or written or graphic materials to promote commercial or moneymaking activity on racks which prevent their being blown about by the wind. 12.16.030 Violation--Penalty.

Any person violating the provisions of this chapter shall, upon conviction thereof, be guilty of a misdemeanor, and shall be punishable by imprisonment in the county jail for a period of six months, or a fine of five hundred dollars. (Ord. 478 §3(part), 1972)
