ARTICLE I. PIERS, FLOATS AND BOAT LAUNCHING RAMPS

12.28.010 Findings.

It is found and determined that the public health, safety and welfare of all the citizens of the city require that the use and enjoyment of city piers, floats and launching ramps located on Clear Lake be regulated as follows in this article. (Ord. 778 §1(part), 1996)

12.28.020 Fishing and swimming Prohibited where.

Fishing or swimming is not permitted on, to or from the piers or floats immediately adjacent to the Third Street and Fifth Street boat launching ramps. (Ord. 778 §1(1), 1996)

12.28.030 Docking--Hours permitted.

Docking at all piers or floats, except the floats located adjacent to the Third Street and Fifth Street ramps, is permitted for public use and convenience from five a.m. until midnight; docking is prohibited between the hours of midnight and five a.m. (Ord. 778 §1(2), 1996)

12.28.040 Camping prohibited.

It is unlawful for any person or persons to camp, or to occupy overnight between the hours of midnight and five a.m., any public piers, floats or related facilities along the boundaries of the waterfront of the city. (Ord. 778 §1(3), 1996)

12.28.050 Docking--Third and Fifth Street ramps.

Docking at the piers or floats located adjacent to the Third Street and Fifth Street ramps will only be permitted as follows:

The sides of said piers or floats which are adjacent to the ramps, and which are painted green in color, are reserved for public use and enjoyment; each user is limited to a maximum ten-minute docking period. (Ord. 778 §1(4), 1996)

12.28.055 Parking restricted.

Parking a vehicle or boat on either the Third Street or Fifth Street ramps, or blocking vehicle or boat access thereto, for more than ten minutes is prohibited. (Ord. 778 §1(5), 1996)

12.28.060 Exceptions.

Exceptions to this article may be made for special events that have been approved in advance by the city council. (Ord. 778 §1(6), 1996)

12.28.065 Violation--Penalty.

Any violation of this article is an infraction punishable by a fine not to exceed two hundred dollars for each violation. (Ord. 778 §1(7), 1996)

ARTICLE II. USE OF MUNICIPAL WHARVES

12.28.070 Fishing permitted--Casting style restricted.

Fishing with hook and line from municipal wharves and piers is permitted, but it is unlawful for any person to use throw-out lines or to throw lines overhead. (Ord. 135 §1, 1911)

12.28.080 Littering prohibited.

It is unlawful for any person to deposit and leave any fish, remnants of such, bottles or other debris on any public municipal wharf or wharves, but every person bringing the same thereon shall keep them in a receptacle and when leaving, remove them. (Ord. 135 §2, 1911)

12.28.090 Vandalism prohibited.

It is unlawful for any person to write upon, cut or otherwise deface any portion of the wharf or wharves or any buildings attached thereto. (Ord. 135 §3, 1911)

12.28.100 Docking or anchoring--Residents--Time limits.

It is unlawful for any person or persons residing in the city to tie, anchor or leave boats, barges or any other floating vessel or vessels upon the street side of any public municipal wharf longer than one hour at any one time. (Ord. 135 §4, 1911)

12.28.110 Docking or anchoring--Nonresidents--Time limits.

It is unlawful for any person or persons, nonresidents of the city, to tie, anchor or leave any boats, barges, or any other floating vessel or vessels upon the street side of any public municipal wharf longer than five hours at any one time; provided, however, any person having barges to load or unload may tie up to the street side of any public municipal wharf for a period of not longer than eight hours at any one time of loading or unloading. 12.28.120 Enforcement authority.

It is made the duty of the chief of police to enforce the provisions of this article and to arrest any person violating them. (Ord. 135 §6, 1911)

12.28.130 Violation--Penalty.

Any person violating any of the provisions of this article shall be fined not less than five dollars nor more than twenty-five dollars. (Ord. 135 §7, 1911)

ARTICLE III. OPERATION OF WATERCRAFT

12.28.140 Hazardous operation prohibited.

It is unlawful for any person to operate any boat or other water-going device on any waters within the city limits of the city in a manner dangerous to other boats or the life or limb of any person. (Ord. 348 §1, 1957)

12.28.150 Operation while intoxicated prohibited.

It is unlawful for any person to operate any boat or other watergoing device upon any waters within the city limits of the city while under the influence of intoxicating liquor or narcotics, or other drugs impairing the physical abilities of the operator. (Ord. 348 §2, 1957)

12.28.160 Violation--Penalty.

Any person who violates any of the provisions of this article shall be guilty of a misdemeanor and, upon conviction therefor, shall be subject to a fine not to exceed one hundred dollars, or by imprisonment in the county jail for a period of not more than thirty days, or by both such fine and imprisonment.
