FLOODPLAIN ADMINISTRATOR:

15-13.1 Designation:

The Director of Public Works is appointed to administer and implement this Chapter by granting or denying development permits in accordance with its provisions. (Code 1972 §12 1/2-13; Ord. #1095, §1; Ord. #1301, §12 1/2-14)

15-13.2 Duties And Responsibilities:

The duties and responsibilities of the Floodplain Administrator shall include, but not be limited to:

a. Permit Review:

1. Review all development permits to determine that the permit requirements of this Chapter have been satisfied.

2. All other required State and Federal permits have been obtained.

3. The site is reasonably safe from flooding,

4. The proposed development does not adversely affect the carrying capacity of the floodway. For purposes of this Chapter, adversely affects shall mean that the cumulative effect of the proposed development when combined with all other existing and anticipated development will not increase the water surface elevation of the base flood more than one foot (1') at any point.

b. Use Of Other Base Flood Data: When base flood elevation data has not been provided in accordance with Section 15-7 of this Chapter, the Floodplain Administrator shall obtain, review, and reasonably utilize any base flood elevation and floodway data available from a Federal, State or other source, in order to administer Section 15-14 of this Chapter. Any such information shall be submitted to the City Council for adoption.

c. Alteration Or Relocation Of Watercourse: Whenever a watercourse is to be altered or relocated:

1. Notify adjacent communities and the California Department of Water Resources prior to such alteration or relocation of a watercourse, and submit evidence of such notification to the Federal Insurance Administration.

2. Require that the flood carrying capacity of the altered or relocated portion of the watercourse is maintained.

d. Provide Certifications For Public Inspection: Obtain and maintain for public inspection and make available as needed:

1. The certification required in subsection 15-14c1 (lowest floor elevation).

2. The certification required in subsection 15-14c2 (elevations in areas of shallow flooding).

3. The certification required in subsection 15-14c3 (elevation or floodproofing of nonresidential structures).

4. The certification required in subsection 15-14c4(a) (wet floodproofing standard).

5. The certified elevation required in subsection 15-16b (subdivision standards).

6. The certification required in subsection 15-18a (floodway encroachments).

e. Interpretation Of Boundaries: Make interpretations where needed, as to the exact location of the boundaries of the areas of special flood hazards (for example, where there appears to be a conflict between a mapped boundary and actual field conditions). The person contesting the location of the boundary shall be given a reasonable opportunity to appeal the interpretation as provided in Section 15-19 of this Chapter.

f. Remedy Violations: Take action to remedy violations of this Chapter as specified in Section 15-8 of this Chapter.

g. AR Zone Duties:

1. Use the adopted Official Map or legal description of those designated developed areas within Zones AR, AR/AH, AR/AO as defined in Section 15-5 of this Chapter (see definition of “area of shallow flooding”) to determine if the proposed project is in a developed area.

2. Determine the base flood elevation to be used for individual projects within developed areas, areas not designated as developed areas, and dual zone areas. (See Section 15-18A of this Chapter.)

3. Require the applicable standard in Section 15-14 of this Chapter.

4. Provide written notification to the permit applicant that the area has been designated as an AR, AR/A1-A30, AR/AE, AR/AH, AR/AO, or AR/A Zone and whether the structure will be elevated or protected to or above the AR base flood elevation.
