2.40.010 Creation—Purpose.

To promote and ensure the comprehensive and adequate planning and historic preservation of the city, there is established the planning and historic preservation commission of the city of Marysville. (Ord. 1216 (part), 1996; Ord. 1149 § 3 (part), 1992).

2.40.020 Membership—Method of appointment.

There is hereby established for the city of Marysville the planning and historic preservation commission, the members of which shall be appointed by the council. The number of members of the commission shall be seven. Each councilmember shall appoint one member, the mayor shall appoint one member, and two members with special expertise in history, engineering, architecture or design shall be appointed by the mayor with confirmation by the city council. The five members directly appointed by each councilmember and the mayor must reside in the city of Marysville. The two members with special expertise appointed by the mayor with conformation by the city council must reside within Yuba or Sutter counties. (Ord. 1216 (part), 1996; Ord. 1149 § 3 (part), 1992).

2.40.030 Term of office—Vacancies.

The five planning and historic preservation commission members directly appointed shall serve while their appointing city councilmember or mayor serves on the council. If a planning and historic preservation commission vacancy occurs other than by expiration of term, the appointing city councilmember or mayor shall appoint a planning and historic preservation commission member, subject to the concurrence of a majority of the city council, for the appointing councilmember or mayor’s remaining time in office. If a councilmember or mayor serves less than his or her term, the term of the planning and historic preservation commission member appointed by that councilmember or mayor shall expire on the last day the appointing councilmember or mayor holds office. The councilmember or mayor elected or appointed to fill the vacancy shall appoint a planning and historic preservation commission member in accordance with provisions of Section 2.40.020.

The term of office for the two special members shall be four years, except for the initial appointment of the two special members which shall be for one two-year term and one four-year term. (Ord. 1216 (part), 1996; Ord. 1149 § 3 (part), 1992).

2.40.040 Removal from office.

Planning and historic preservation commission members serve at the pleasure of the city council. Any member of the planning and historic preservation commission may at any time be removed from office, without cause, by the appointing councilmember or mayor, as appropriate. Any member of the planning and historic preservation commission shall be removed from office if the member fails to attend three consecutive meetings of the commission or fails to attend a minimum of seventy-five percent of all commission meetings during a continuous six-month period of time. The removal from office shall be mandatory unless disapproved by the city council. Any member of the commission unable to attend a meeting shall give notice to the secretary of the planning and historic preservation commission at least one business day prior to the date of the meeting. If a member is absent without permission of the chairman from all regular meetings for sixty days consecutively from the last regular meeting attended, his/her office shall be deemed to be vacant. 2.40.050 Powers and duties.

The planning and historic preservation commission shall have and exercise all the powers and duties which are now or may hereafter be granted to or imposed upon the commission by state law, and such additional power and duties as may be granted or imposed by ordinances and resolutions of the city and the rules and regulations pursuant to Section 2.40.060. 2.40.060 Meetings.

The planning and historic preservation commission shall meet at least once a month, keep a public record of its resolutions, findings and determinations, and adopt rules and regulations pertaining to its meetings and the transaction of its business. The commission’s rules and regulations, or any amendments thereto, shall not become effective until approved by a majority of the city council. Special meetings may be called at any time by the chairman or by two members of the commission. Four members shall constitute a quorum for the transaction of business except as otherwise provided in state law or ordinance of the city. No action shall be taken without receiving the affirmative vote of at least four members of the commission.

In holding regular, special and adjourned meetings, the commission shall abide by the provisions of the Ralph M. Brown Act of the state of California (Government Code Section 54950 et seq.).

The commission shall, immediately after appointment, and thereafter, at yearly intervals, meet and choose one of its members to act as chairman and vice-chairman. The commission shall cause the staff to keep an accurate record of its proceedings. (Ord. 1216 (part), 1996; Ord. 1149 § 3 (part), 1992).

2.40.070 Officers.

The planning and historic preservation commission shall elect its chairman and vice-chairman from among the five directly appointed members for a term of one year at the first regular meeting in January of each year. The chairman’s and vice-chairman’s titles and powers may, at any time, be reassigned by a majority vote of the commission. (Ord. 1216 (part), 1996; Ord. 1149 § 3 (part), 1992).

2.40.080 Funds.

The city council shall provide the funds, equipment and accommodations necessary for the work of the planning and historic preservation commission. (Ord. 1216 (part), 1996; Ord. 1149 § 3 (part), 1992).

2.40.090 Compensation.

Each member of the planning and historic preservation commission shall receive the sum of fifteen dollars for each planning and historic preservation commission meeting attended. (Ord. 1216 (part), 1996; Ord. 1149 § 3 (part), 1992).
