10.42.010 Definitions.

The following definitions shall apply in construing the provisions of this chapter:

(1)    "Central traffic area" means E Street between Third Street and Tenth Street, Tenth Street between E Street and H Street, D Street between First Street and Ninth Street, C Street between First Street and Ninth Street, F Street between Third Street and Tenth Street, Fifth Street between B Street and H Street.

(2)    "Cruising" means the driving of a motor vehicle on a street or highway within the central traffic area past a traffic control point in traffic which is congested at or near the traffic control point, as determined by the ranking police officer on duty in the affected area, three or more times within a four-hour period if on any prior trip past such control point during such four-hour period, the vehicle operator was given a written notice that further driving past the control point within four hours after such notice was given would be a violation of the provisions of this chapter and would subject the violator to the penalties set forth herein.

(3)    "Highway" shall have the meaning set forth in Section 360 of the Vehicle Code.

(4)    "Motor Vehicle" shall have the meaning set forth in Section 415 of the Vehicle Code.

(5)    "Street" shall have the meaning set forth in Section 590 of the Vehicle Code.

(6)    "Traffic control point" means any location within the central traffic area which is temporarily established for the purpose of:

(a)    Monitoring the movement of motor vehicles past such location;

(b)    Warning persons that further driving past such location within a four-hour period will constitute a violation of the ordinance codified in this chapter; and

(c)    Determining those persons who violate the ordinance codified in this chapter by driving past such location within four hours after having received such warning. (Ord. 1038 § 1 (part), 1986).

10.42.020 Cruising prohibited.

(a)    Cruising in the central traffic area is prohibited.

(b)    No person shall be guilty of cruising unless:

(1)    That person has driven a motor vehicle past the same traffic control point three or more times within a four-hour period and has, upon driving past the traffic control point on a previous trip been given written notice that further driving past such traffic control point will be a violation of this chapter; and

(2)    Signs have been posted on the streets subject to cruising controls pursuant to Section 10.42.040. (Ord. 1038 § 1 (part), 1986).

10.42.030 Exclusion.

The provisions of this chapter shall not apply to in-service emergency vehicles, taxicabs for hire, buses or other vehicles being driven solely for business purposes. (Ord. 1038 § 1 (part), 1986).

10.42.040 Signs.

The beginning and end of any portion of any street or highway within the central traffic area subject to the cruising controls and penalties provided for in this chapter shall be clearly identified by signs which briefly and clearly state the appropriate provisions of Section 21100(k) of the Vehicle Code and this chapter. The chief of police is authorized to place temporary or permanent signs on all or any portion of any street within the central traffic area as may be necessary or appropriate to enforce the provisions of this chapter. 10.42.050 Violations and penalties.

Any person violating the provisions of this chapter shall be guilty of an infraction. Each trip past a control point by a vehicle operator after such person has received the notice prescribed in Section 10.42.010 shall constitute a separate offense and shall be punishable as an infraction. The conviction of each infraction under the provisions of this chapter shall be punishable by a fine of seventy-five dollars for a first violation and a fine of one hundred fifty dollars for each subsequent violation.
