It is unlawful for any person under the age of eighteen years to loiter upon or about the public streets, avenues, alleys, parks, or any public place in the city, between the hours of eleven p.m. and the time of sunrise of the following morning, when his parent or legal guardian having the care, and custody of such minor has not expressly consented to such activity. It is presumed that any person under the age of eighteen found in any public place within the city between the hours of eleven p.m. and sunrise of the following day is not engaging in such activity with the consent of his parent or legal guardian and said minor person may be detained pending a determination of whether consent, in fact, has been given.
