8.24.010 Police department duty.

The police department shall take charge of all lost or abandoned property which is turned in to it or which comes into possession of the department in the course of its work and shall keep such property for the purpose of restoring it to the person entitled thereto; provided, however, that if such property is unclaimed, it shall be disposed of in accordance with the provisions of Section 8.24.030. (Prior code § 15A.1).

8.24.020 City manager to establish schedule of charges.

The city manager may establish a schedule of storage charges to be paid by the parties entitled to any property taken into the custody of the police department for the necessary costs and disbursements incurred in caring for such property and locating the persons entitled thereto. (Prior code § 15A.2).

8.24.030 Sale of unclaimed property.

If any such property, except unclaimed bicycles, so taken into care and custody of the police department remains unclaimed for a period of six months, or for a period of three months in the case of unclaimed bicycles, or if the claimant refuses to pay the charges as prescribed, then the property may be so sold in the following manner:

(1)    At least five days’ previous notice of intended sale shall be given by publishing notice of sale once in a newspaper of general circulation published in the county, giving the time and place of such sale and generally describing the property to be sold;

(2)    At the time and place fixed for such sale, property shall be auctioned by the chief of police or his appointee to the highest bidder in lawful money of the United States;

(3)    The proceeds from such sales shall be turned into the treasurer of the city and deposited in the general fund of the city after deducting expenses of sale. (Prior code § 15A.3).
