8.29.010 Definitions.

For purposes of this chapter, the following definitions shall apply:

(1)    "In-line Skates." Also known as "roller blades," a footwear containing three (3) or more axles mounted in a straight line extending generally from or behind the heel of the footwear to or in front of the toe of the footwear with a single wheel attached to each axle.

(2)    "Roller Skates." Any footwear or device which may be attached to the foot or footwear to which wheels are attached and such wheels may be used by the wearer in moving.

(3)    "Skateboard." A board-like object, which has two (2) axles, attached to the bottom of the board-like object with one (1) or two (2) wheels attached to each axle and the user rides or stands upon the board-like object, and it may include a handlebar. (Ord. 914 § 2 (part), 2002).

8.29.020 Public skate park designated; use regulations.

The city of Menlo Park may designate, maintain and/or operate a skate park facility, which shall be open to the public for the purpose of riding skateboards, in-line skates and/or roller skates. Any designated public skate park may or may not be supervised and shall be for use by persons using skateboards, in-line skates and/or roller skates only. All other uses are prohibited. (Ord. 914 § 2 (part), 2002).

8.29.030 Required riding equipment in public skate parks.

It is unlawful for a person to ride or use a skateboard, in-line skates or roller skates, in a designated public skate park facility unless a person is wearing a helmet, elbow pads and knee pads. (Ord. 914 § 2 (part), 2002).

8.29.040 Hazardous recreational activity.

Skateboarding, in-line skating and or roller skating at a designated public skate park facility represents a hazardous recreational activity for participants, and the city of Menlo Park will not be liable for any injuries incurred by persons participating in the hazardous recreational activity at a designated public skate park facility owned and/or operated by the city of Menlo Park. 8.29.050 Skate park facility sign posting.

The Menlo Park community services department shall cause a sign or signs to be posted at designated public skate park facilities providing reasonable notice of the requirements of this chapter and stating that any person failing to comply will be guilty of an infraction and subject to citation. Such signs shall at least afford reasonable notice of the following:

(1)    Park hours of operation;

(2)    Skateboarding, roller skating and in-line skating are hazardous activities. Skate at your own risk;

(3)    Skateboards, roller skates and in-line skates only; and

(4)    Failure to wear helmets, kneepads and elbow pads will subject persons to citation. (Ord. 914 § 2 (part), 2002).

8.29.060 Administration.

The provisions of this chapter shall be administered by the chief of police and his or her authorized representatives, except where expressly provided otherwise. All other officers and employees of the city shall assist and cooperate in the administration and enforcement of this chapter. (Ord. 914 § 2 (part), 2002).

8.29.070 Violations.

Violations of the provisions of this chapter shall be guilty of an infraction and shall be punished as provided in section 1.12.010(b). (Ord. 914 § 2 (part), 2002).
