4.40.010 Maximum gross vehicle weights on streets.

A.    1. The use of streets, as defined in MMC 4.05.010, by any vehicle exceeding a specified maximum gross vehicle weight is restricted as described in this chapter.

2.    The limitations specified herein shall not be effective until the director of public works has caused the installation of appropriate signs giving notice of such limitations.

B.    The maximum gross vehicle weight, including the load thereon, of any vehicle operated or moving on a street within the city shall be as specified below:

1.    Maximum Gross Vehicle Weight of Twenty-Seven Thousand Pounds. Millbrae Avenue between U.S. 101 and El Camino Real (State Route 82).

2.    Maximum Gross Vehicle Weight of Eight Thousand Five Hundred Pounds.

a.    Millbrae Avenue between El Camino Real (State Route 82) and Skyline Boulevard;

b.    Skyline Boulevard between Millbrae Avenue and Larkspur Drive;

c.    Old Bayshore Highway and Rollins Road between south city limits and Millbrae Avenue;

d.    Millbrae Avenue between Bayshore Highway and U.S. 101;

e.    Murchison Drive between California Drive and El Camino Real (State Route 82).

3.    Maximum Gross Vehicle Weight of Six Thousand Pounds. All other streets within the city. (Ord. 625, § 1; 1976 Code § 4-8.01).

4.40.020 Exceptions.

A.    Pickups and Deliveries. The provisions of this chapter shall not prohibit any commercial vehicle coming from the streets designated in MMC 4.40.010(B)(1) and (B)(2) from having ingress and egress by direct route to and from all other streets, when necessary for the purpose of making pickups and deliveries of goods, wares and merchandise from or to any building or structure located on said streets, or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon said streets for which a building permit has been previously obtained.

B.    Public Utility Vehicles. The provisions of this chapter shall not apply to any vehicle owned by a public utility or a licensed contractor while necessarily in use in the construction, installation or repair of any public utility.

C.    Passenger Stage Vehicles. The provisions of this chapter shall not apply to any passenger stage corporation vehicles subject to the provisions of Sections 1031 through 1036 of the Public Utilities Code.

D.    Exempted or Emergency Vehicle. The provisions of this chapter shall not apply to any vehicle exempted by the provisions of the California Vehicle Code, or to any authorized emergency vehicle as defined in Section 165 of the California Vehicle Code.

E.    State Highway. Nothing contained in this chapter shall refer or apply to any state highway. For the purposes of this section, the following are designated state highways within the corporate limits of the city:

1.    Interstate 280;

2.    U.S. 101;

3.    El Camino Real (State Route 82). (Ord. 625, § 1; 1976 Code § 4-8.02).

4.40.030 Permits for variances.

A.    The director of public works may at his/her discretion and if good cause appears, issue a special permit allowing a vehicle or vehicles of a gross vehicle weight exceeding the maximums specified in MMC 4.40.010 to be operated on or moved over specified streets.

B.    Said permits shall be issued pursuant to the procedures specified in Sections 35780 et seq., of the California Vehicle Code.

C.    A violation of the terms and conditions of a special permit is punishable by a fine of up to five hundred dollars or imprisonment in the county jail for six months, or both, pursuant to California Vehicle Code Section 35784. An additional fine may be levied for having excess weight pursuant to Vehicle Code Section 42030. (Ord. 625, § 1; 1976 Code § 4-8.03).
